 بسم الله و الحمد لله ، والصلاة والسلام على رسول الله ، وعلى آله وصحبه ومن تولاه وبعد 
Marry after fornication: rulings

The scholars of the Standing Committee were asked: 

A man committed zina with a virgin and wants to marry her. Is it permissible for him to do that? 

They replied: 

If the matter is as described, each of them must repent to Allaah and give up this sin, and regret what has happened of immoral actions, and resolve not to do it again, and do a lot of good deeds, in the hope that Allaah will accept their repentance and turn their bad deeds into good. Allaah says (interpretation of the meaning): 

“And those who invoke not any other ilaah (god) along with Allaah, nor kill such person as Allaah has forbidden, except for just cause, nor commit illegal sexual intercourse ___ and whoever does this shall receive the punishment.

69. The torment will be doubled to him on the Day of Resurrection, and he will abide therein in disgrace;

70. Except those who repent and believe (in Islamic Monotheism), and do righteous deeds; for those, Allaah will change their sins into good deeds, and Allaah is Oft‑Forgiving, Most Merciful

71. And whosoever repents and does righteous good deeds; then verily, he repents towards Allaah with true repentance”

[al-Furqaan 25:68-70] 

If he wants to marry her, then he must wait for one menstrual cycle to establish whether her womb is empty before doing the marriage contract with her. If it turns out that she is pregnant, then it is not permissible for him to do the marriage contract with her until after she gives birth, in accordance with the hadeeth in which the Prophet (peace and blessings of Allaah be upon him) forbade a man to water the crop of another with his own water.

وسئل علماء اللجنة الدائمة : 
زنى رجل ببكرٍ ويريد أن يتزوجها فهل يجوز له ذلك ؟ 
فأجابوا : 
" إذا كان الواقع كما ذكر : وجب على كلٍّ منهما أن يتوب إلى الله فيقلع عن هذه الجريمة ، ويندم على ما حصل منه من فعل الفاحشة ، ويعزم على ألا يعود إليها ، ويكثر من الأعمال الصالحة ، عسى الله أن يتوب عليه ويبدل سيئائه حسنات ، قال الله تعالى : ( وَالَّذِينَ لا يَدْعُونَ مَعَ اللَّهِ إِلَهاً آخَرَ وَلا يَقْتُلُونَ النَّفْسَ الَّتِي حَرَّمَ اللَّهُ إِلَّا بِالْحَقِّ وَلا يَزْنُونَ وَمَنْ يَفْعَلْ ذَلِكَ يَلْقَ أَثَاماً . يُضَاعَفْ لَهُ الْعَذَابُ يَوْمَ الْقِيَامَةِ وَيَخْلُدْ فِيهِ مُهَاناً . إِلَّا مَنْ تَابَ وَآمَنَ وَعَمِلَ عَمَلاً صَالِحاً فَأُولَئِكَ يُبَدِّلُ اللَّهُ سَيِّئَاتِهِمْ حَسَنَاتٍ وَكَانَ اللَّهُ غَفُوراً رَحِيماً . وَمَنْ تَابَ وَعَمِلَ صَالِحاً فَإِنَّهُ يَتُوبُ إِلَى اللَّهِ مَتَاباً ) الفرقان/68 – 71 . وإذا أراد أن يتزوجها : وجب عليه أن يستبرئها بحيضة قبل أن يعقد عليها النكاح ، وإن تبين حملها : لم يجز له العقد عليها إلا بعد أن تضع حملها ، عملاً بحديث نهي النبي صلى الله عليه وسلم أن يسقي الإنسان ماءه زرع غيره " " فتاوى إسلامية " ( 3 / 247 ) .

Shaykh Ibn ‘Uthaymeen (may Allah have mercy on him) said in ash-Sharh al-Mumti‘ (13/382): Rather the opinion narrated from Abu Bakr and a number of the Sahaabah (may Allah be pleased with them) is that there is no ‘iddah at all for the woman who committed zina, and there is no requirement to establish that there is no pregnancy, especially if she has a husband, because of the words of the Messenger (blessings and peace of Allah be upon him): “The infant is to be attributed to the husband of the woman (who gave birth to him).” Rather if a man knows that his wife has committed zina – Allah forbid – and has repented, he should have intercourse with her immediately, so that no doubt will remain in his heart in the future as to whether she became pregnant as a result of zina or not. If he has intercourse with her immediately, the child will be assumed to be from the husband and not from the zaani (adulterer). 

But if the woman who committed zina (fornication) did not have a husband, it is essential to establish that there is no pregnancy by waiting for one menstrual cycle, according to the correct opinion.

الشيخ ابن عثيمين رحمه الله : " بل إن القول المروي عن أبي بكر وجماعة من الصحابة قالرضي الله عنهم أن المزني بها لا عدة عليها إطلاقاً ولا تستبرئ ، لا سيما إذا كانت ذات زوج ؛ لقول الرسول عليه الصلاة السلام: (الولد للفراش) ، بل ينبغي للإنسان إذا علم أن زوجته زنت - والعياذ بالله - وتابت أن يجامعها في الحال ، حتى لا يبقى في قلبه شك في المستقبل ، هل حملت من جماع الزنا أو لم تحمل ؟ فإذا جامعها في الحال حُمِلَ الولد على أنه للزوج ، وليس للزاني . 
أما إذا كانت المرأة الزانية ليس لها زوج فلا بد أن تستبرئ بحيضة على القول الراجح “

Shaykh al-Islam Ibn Taymiyah (may Allah have mercy on him) said: 

Marriage to a zaaniyah (a woman who has committed fornication) is haraam until she repents, whether the one who committed zina with her is the bridegroom himself or someone else. This is the correct opinion beyond a doubt, and it is the opinion of a number of the earlier and later scholars, including Ahmad ibn Hanbal and others. Many of the earlier and later scholars were of the view that it is permissible, and this is the view of the three, but Maalik stipulated that it should be established that there is no pregnancy by waiting for one menstrual cycle, and Abu Haneefah regarded it as permissible to do the marriage contract before waiting for one menstrual cycle if she is pregnant, however if she is pregnant it is not permissible to have intercourse with her until she gives birth. Ash-Shaafa‘i regarded it as permissible to do the marriage contract and to have intercourse in all cases, because the water (semen) of the zaani has no value in sharee‘ah and the ruling is that no child is to be attributed to him. This is his justification for his opinion. Abu Haneefah differentiated between the one who is pregnant and the one who is not, because if (the husband) has intercourse with the one who is pregnant, he will be attributing to himself a child who definitely is not his, which is different from the case of one who is not pregnant. Maalik and Ahmad stipulated that it should be established that there is no pregnancy (by waiting for one menstrual cycle), which is the correct view. But Maalik and Ahmad, according to another report, stipulated that it should be established that there is no pregnancy by waiting for one menstrual cycle. The other report from Ahmad is that which is followed by many of his companions such as al-Qaadi Abu Ya‘la and his followers, which is that it is essential to wait for three menstrual cycles. However the correct view is that all that is required is to establish that there is no pregnancy (by waiting for one menstrual cycle).

قال شيخ الإسلام ابن تيمية رحمه الله :

" نِكَاحُ الزَّانِيَةِ حَرَامٌ حَتَّى تَتُوبَ سَوَاءٌ كَانَ زَنَى بِهَا هُوَ أَوْ غَيْرُهُ ، هَذَا هُوَ الصَّوَابُ بِلَا رَيْبٍ وَهُوَ مَذْهَبُ طَائِفَةٍ مِنْ السَّلَفِ وَالْخَلَفِ : مِنْهُمْ أَحْمَد بْنُ حَنْبَلٍ وَغَيْرُهُ وَذَهَبَ كَثِيرٌ مِنْ السَّلَفِ وَالْخَلَفِ إلَى جَوَازِهِ وَهُوَ قَوْلُ الثَّلَاثَةِ ؛ لَكِنْ مَالِكٌ يَشْتَرِطُ الِاسْتِبْرَاءَ وَأَبُو حَنِيفَةَ يُجَوِّزُ الْعَقْدَ قَبْلَ الِاسْتِبْرَاءِ إذَا كَانَتْ حَامِلًا ؛ لَكِنْ إذَا كَانَتْ حَامِلًا لَا يَجُوزُ وَطْؤُهَا حَتَّى تَضَعَ وَالشَّافِعِيُّ يُبِيحُ الْعَقْدَ وَالْوَطْءَ مُطْلَقًا ؛ لِأَنَّ مَاءَ الزَّانِي غَيْرُ مُحْتَرَمٍ وَحُكْمُهُ لَا يَلْحَقُهُ نَسَبُهُ ، هَذَا مَأْخَذُهُ ، وَأَبُو حَنِيفَةَ يُفَرِّقُ بَيْنَ الْحَامِلِ وَغَيْرِ الْحَامِلِ ؛ فَإِنَّ الْحَامِلَ إذَا وَطِئَهَا اسْتَلْحَقَ وَلَدًا لَيْسَ مِنْهُ قَطْعًا ؛ بِخِلَافِ غَيْرِ الْحَامِلِ ، وَمَالِكٌ وَأَحْمَد يَشْتَرِطَانِ " الِاسْتِبْرَاءَ " وَهُوَ الصَّوَابُ ؛ لَكِنْ مَالِكٌ وَأَحْمَد فِي رِوَايَةٍ يَشْتَرِطَانِ الِاسْتِبْرَاءَ بِحَيْضَةِ وَالرِّوَايَةُ الْأُخْرَى عَنْ أَحْمَد هِيَ الَّتِي عَلَيْهَا كَثِيرٌ مِنْ أَصْحَابِهِ كَالْقَاضِي أَبِي يَعْلَى وَأَتْبَاعِهِ أَنَّهُ لَا بُدَّ مِنْ ثَلَاثِ حِيَضٍ وَالصَّحِيحُ أَنَّهُ لَا يَجِبُ إلَّا الِاسْتِبْرَاءُ فَقَطْ " انتهى من "مجموع الفتاوى" (32 /110) .

Question:

If the husbands wealth is unlawful, what should the wife do?



The Permanent Committee of Scholars:

If she knows that the earnings which the husband brings home is unlawful then it is not allowed for her to take from it. She should seek from him to make an earning from a lawful income, otherwise she should raise the issue to the authorities, such as the Islamic courts.

Praying for Allah to heal non-Muslims is permissible

Explained by the Permanent Committee of Scholars 

Question: Is it permissible for those who utilize the Quran to treat the sick; to recite the Quran to treat non-Muslims?

Answer: It is permissible to treat non-Muslims with the Quran if they are not combatants at war with the Muslims; and if it is done in a manner in which the non-Muslim does not handle the Mushaf. This treatment is implemented by reciting the Quran over them, and praying to Allah to heal them and guide them.

And with Allah lies all success and may the salutations and peace of Allah be upon our Prophet Muhammad, and Muhammad’s family and companions.

 creed of ahl as-Sunnah wa’l-Jamaah?


The scholars of the Standing Committee were asked:

People say that Ibn Taymiyah was not one of Ahl al-Sunnah wa’l-Jamaa’ah, and that he was misled and misled others, and that this is the view of Ibn Hajar and others. Is what they say true or not?

They replied:

Shaykh Ahmad ibn ‘Abd al-Haleem Ibn Taymiyah is one of the imams of Ahl al-Sunnah wa’l-Jamaa’ah, who called people to the truth and to the straight path. Allaah supported the Sunnah by means of him and suppressed the followers of innovation and deviation. The one who regards him as something other than that is the one who is an innovator and is misled and is misleading others. They heard wrong things about him, and they thought that truth was falsehood and falsehood was truth. That is known by the one whom Allaah guides and who reads his books and the books of his opponents, and compares his biography with theirs. This is the best and most decisive testimony between the two parties.

Is it permissible to go to beaches where there is nakedness and free mixing?



In Egypt, people go to Alexandria to spend the summer there. On the beaches there are thousands of women who are virtually naked, and men mix freely with women. I am a man with a beard; is it permissible for me to go there and sit by the sea, or not?

If the situation is as described, it is not permissible for a Muslim to go to these places, for fear of fitnah (temptation) and so as to avoid the places where it is to be found – unless he is one of those who are able to remove the evil things that are there, because they have the authority and the knowledge of sharee’ah, and are able to enjoin what is good and forbid what is evil.

هل يجوز الذهاب إلى الشواطئ التي فيها عري واختلاط ?? 

س 1: يذهب الناس في مصر إلى مدينة الإسكندرية لقضاء الصيف هناك, ويوجد على البحر هناك الآلاف من النساء الكاسيات العاريات, واختلاط الرجال بالنساء, وإني رجل ملتح فهل يجوز لي الذهاب هناك والجلوس على 
البحر أم لا يجوز? 

ج 1: إذا كان الواقع كما ذكر فلا يجوز للمسلم أن يذهب إلى تلك المجتمعات; خشية الفتنة واجتنابا لمواطنها, إلا أن يكون ممن يقوى على إزالة ما فيها من المنكرات; لما له من سلطة ومعرفة بالشرع وقوة على البيان في الأمر بالمعروف والنهي عن المنكر.

Expiating an oath by paying the poor and destitute money


Question: Regarding the expiation of an oath (kaffaaratul-yameen), could you please advise us about the manner in which the obligation of feeding the ten poor and destitute [must take]? Is it [required to feed them] for a whole day, or [just] a single meal for each [poor and destitute] person; And what is the cost [entailed]? And is it permissible to [simply] pay [the poor and destitute] the cost of feeding [them] in money or not?

Response: The expiation of an oath is to feed ten poor and destitute people, with each one receiving half a saa' of wheat, or dates, or rice, or the like from the staple food of the land. And [note] half a saa' amounts to one and a half kilos [in weight]. Or [alternatively], one can clothe ten poor and destitute people - with each receiving a shirt, or [instead] free a believing slave.

If he is unable to carry out any [one] of the aforementioned three [legislated options], then he is required to fast for three days, [bearing in mind] the [cash] payment [to the poor and destitute individuals] for the expiation of an oath will not be rewarded (accepted).

And with Allaah lies all success and may Allaah send prayers and salutations upon our Prophet Muhammad (sal-Allaahu `alayhe wa sallam) and his family and his companions.

Eating the food of one whose wealth is haraam
 
Some Muslims here in Britain accumulate their wealth from both halaal and haraam sources, because they are businessmen and some of the things they sell are alcohol and pork. They vary in the extent to which they do that. In some cases most of the person’s wealth comes from haraam sources and in some cases only a little of his earning is haraam. Is it permissible for us Muslims to mix with them and eat their food if they invite us? Is it permissible for us to accept their donations from this wealth for the mosque?.
 
Firstly: 
 
You have to advise them and warn them of the evil consequences of dealing in haraam things and earning money from haraam sources. You should cooperate with your brothers in reminding them and warning them of the punishment of Allaah and how severely He deals with those who disobey Him. You should tell them that the pleasures of this world are insignificant, and that the Hereafter is better and more lasting. If they respond, then praise be to Allaah, and they will become thereby your brothers in Islam. Then you should advise them to restore the rights of those whom they have wronged, if they know who they are, and to follow up bad deeds with good, so that Allaah may accept their repentance and turn their bad deeds into good. In that case it will be permissible for you to mix with them as brothers and to eat their food, and to accept their donations for building and furnishing the mosque, etc, because by repenting and restoring people’s rights it is possible that they may be forgiven for what they did in the past, because Allaah says concerning those who deal in riba [usury] (interpretation of the meaning):
 
“So whosoever receives an admonition from his Lord and stops consuming Ribaa, shall not be punished for the past”
 
[al-Baqarah 2:275]
 
Secondly:
 
If they refuse to heed the advice and reminders, and they persist in their haraam actions, then you have to forsake them for the sake of Allaah, and not accept their invitations or accept their donations, as a rebuke to them, and in the hope that they will give up their evil ways.
 
And Allaah is the Source of strength.

الأكل مِنْ طعام مَنْ ماله حرام
 
بعض المسلمين عندنا في بريطانيا جمعوا أموالهم من الحلال والحرام ، وذلك أنهم تجار ومما يتجرون فيه الخمور ولحوم الخنازير ، وهم على درجات متفاوتة في ذلك ، فمنهم من أكثر ماله من الحرام ، ومنهم من كسبه من الحرام قليل ، فهل يجوز لنا نحن المسلمين مخالطتهم وأكل طعامهم إذا دعونا ، وهل يحل لنا قبول تبرعاتهم من هذا المال لصالح المسجد ؟.
 
 
أولاً :
 
عليك أن تنصح لهم وتحذرهم سوء عاقبة الاتجار في المحرمات ، وكسب المال من الحرام ، وتتعاون مع إخوانك من أهل الخير على تذكريهم وإنذارهم بأس الله وشديد عقابه من عصاه وحاربه بارتكاب المنكرات ، وتعريفهم أن متاع الدنيا قليل ، وأن الآخرة خير وأبقى ، فإن استجابوا فالحمد لله ، وهم بذلك إخوان لكم في الله ثم انصحوهم برد المظالم إلى أهلها إن عرفوهم ، وأن يُتبعوا السيئة الحسنة ؛ عسى الله أن يتوب عليهم ، ويبدل سيئاتهم حسنات وحينئذٍ يجوز لكم مخالطتهم مخالطة الإخوة ، والأكل من طعامهم ، وقبول تبرعاتهم في وجوه البر ، من بناء مساجد وفراشها ونحو ذلك ؛ لأنهم بالتوبة ورد المظالم إلى أهلها حسب الإمكان يغفر لهم ما قد سلف ؛ لقول الله عز وجل في المرابين : { فمن جاءه موعظةٌ من ربه فانتهى فله ما سلف وأمره إلى الله } .
 
ثانياً :
 
إن أبوا بعد النصيحة والتذكير والإصرار على ما هم فيه من المحرمات فإنه يجب أن تهجروهم في الله ، وألا تستجيبوا لدعوتهم ، وألا تقبلوا تبرعاتهم ؛ زجراً لهم وإنكاراً لمطالبهم ، ورجاء أن يرتدعوا ويرجعوا عما هم عليه من المنكرات .

Hajj of a minor

The most Holiest of place for Muslims. The kaaba..
 
Question: If I want to take my son, who has not yet reached adolescence, with me to Hajj, should I dress him in ihraam clothes and do all the rituals on his behalf, such as doing tawaaf on his behalf, etc., or should I dress him in regular clothes and not do anything on his behalf since he is little and does not have to do Hajj?
 
Answer: If a child has reached the age of discernment but has not yet reached adolescence and his father or guardian wants to take him for Hajj, he should tell him to put on ihraam garments and the child should do all the rituals of Hajj for himself, starting with entering ihraam from the meeqaat, until the end of the actions of Hajj, and his father or guardian should stone the Jamaraat on his behalf if he cannot do that himself. He should tell him to avoid the things that are forbidden whilst in ihraam. But if the child is below the age of discernment, then his father or guardian should make the intention of entering ihraam for Hajj or ‘Umrah on his behalf, and do Tawaaf and Sa’ee with him, and take him with him for all the other rituals, and stone the Jamaraat on his behalf.
 
And Allaah is the Source of strength. May Allaah send blessings and peace upon our Prophet Muhammad.

حج الصغير
 
إذا أردت أن يحج معي ابني الذي لم يبلغ الحلم، هل ألبسه ملابس الإحرام وأقوم نيابة عنه بجميع المناسك كأن أطوف عنه..إلخ، أم ألبسه ملابسه العادية ولا أقوم عنه بشيء طالما أنه صغير ولا حج عليه ؟.
 
 الصبي المميز الذي لم يبلغ الحلم إذا أراد وليه أن يحج به فإنه يأمره بأن يلبس ملابس الإحرام، ويفعل (الصبي ) بنفسه جميع مناسك الحج ابتداءً من الإحرام من الميقات إلى آخر أعمال الحج، ويرمي عنه ( وليه ) إن لم يستطع الرمي بنفسه، ويأمره بأن يجتنب المحظورات في الإحرام ، وإذا لم يكن مميزاً فإنه ( أي وليه ) ينوي عنه الإحرام بعمرة أو حج ، ويطوف ويسعى به ويُحضره معه في بقية المناسك ويرمي عنه.

Ruling on making models of the Ka‘bah to explain the rituals of Hajj

Shaykh Ibn Uthaymeen (may Allah have mercy on him) was asked about a school that teaches the students about Hajj and umrah but the students do not understand properly; it is permissible to make a model of the Kaba and holy places in the school so that they can learn in practical terms and not just theoretically.
 
He replied:
 
This is not permissible and it is not appropriate at all. The teacher can draw a picture of the Kaba on the blackboard and say, We circumambulate it like this… But as for making a model, this to my mind is turning acts of worship into mere movements with no impact on the heart.

It says in a fatwa of the Standing Committee: It is not permissible to make models of the Kaba and the (green) dome that is over the grave of the Prophet (blessings and peace of Allah be upon him).

الشيخ ابن عثيمين – رحمه الله – عن مدرس يشرح للطلاب صفة الحج والعمرة ولكن يقول: لا يستوعب الطلاب استيعاباً جيداً فهل يجوز أن أجعل في المدرسة مجسماً للكعبة والمشاعر حتى يطبقونها تطبيقاً عملياً ؟

فأجاب فضيلته بقوله : هذا لا يجوز، ولا ينبغي إطلاقاً ، ويستطيع أنه يرسم في السبورة صورة كعبة ، ويقول : تطوف عليها هكذا ، أما أن يجعل مجسماً ، فهذا في ظني أنه يجعل العبادات مجرد طقوس وحركات فقط ، ليس لها تأثير في القلب " .

Q 3: What is the ruling on attending a disbeliever's Funeral as this is a political tradition and common custom?

A: Muslims are not allowed to bury the corpses of disbelievers as long as disbelievers can do so. Muslims are also not permitted to participate or help disbelievers in burying their dead in order to follow political traditions. This was not done by the Prophet (peace be upon him) nor by the rightly guided Caliphs. Allah forbade His Prophet (peace be upon him) to stand at the grave of `Abdullah ibn Ubayy ibn Salul, because he was a disbeliever. Allah (Exalted be He) says: And never (O Muhammad صلى الله عليه وسلم) pray (funeral prayer) for any of them (hypocrites) who dies, nor stand at his grave. Certainly they disbelieved in Allâh and His Messenger, and died while they were Fâsiqûn (rebellious, - disobedient to Allâh and His Messenger صلى الله عليه وسلم). If there are no disbelievers who can bury their dead, Muslims should do so. This was done by the Prophet (peace be upon him) with regard to the disbelievers who were killed during the battle of Badr. When his uncle Abu Talib died, the Prophet (peace be upon him) said to `Aly: "Go and bury him."
May Allah grant us success. May peace and blessings be upon our Prophet Muhammad, his family, and Companions.

Burying the Kafir (Disbeliever)

Fourth question from Fatwa no. 13477
Q 4: what is the ruling on those who embrace Islam while their parents are still polytheists who worship idols until they die? Is it permissible for their Muslim son to participate in washing and burying them? What is the ruling if the son participates in washing and burying them and other ceremonies of the non-Muslims? What should a Muslim son do after these acts?
A: As a general rule, when a Kafir dies, their relatives should hide their corpse in a hole so that people will not be harmed by them. Neither Janazah (Funeral) Prayer should be performed for them nor they should be washed or shrouded. Anyone who does differently or participates with the non-Muslims in their habits, should repent and ask for Allah's forgiveness. We hope that Allah will accept his repentance.
May Allah grant us success. May peace and blessings be upon our Prophet Muhammad, his family, and Companions.

س4: ما حكم الإنسان الذي أسلم ووالده كافر مشرك يعبد الأصنام حتى مات مشركًا، وهل يجوز لابنه المسلم أن يشترك في غسله ودفنه؟ وإذا اشترك في غسله ودفنه وعادات 
الكفار وما حكمه في الإسلام؟ وماذا يعمل ابن المسلم بعد هذه الأعمال؟

ج4 : الأصل في الكافر إذا مات أن يواريه أقاربه في حفرة حتى لا يتأذى به الناس، ولا يغسل ولا يكفن، ولا يصلى عليه، ومن فعل غير ذلك أو اشترك مع الكفار في عاداتهم فعليه أن يتوب ويستغفر الله، لعل الله أن يتوب عليه.
وبالله التوفيق وصلى الله على نبينا محمد وآله وصحبه وسلم.

Question:

Can a person commit kufr (disbelief) whilst upon his tongue is laa ilaaha ill Allaah (none has the right to be worshipped in Truth except Allaah)?

Answer:

A person can indeed become a disbeliever in front of Allaah whilst he says la ilaaha ill Allaah.
And this is just like the hypocrite who said la ilaaha ill Allaah with his tongue and he did not believe with his heart, such as Abdullaah ibn Abee Sulool and the like of him.

And with Allaah is the tawfeeq. And may peace and blessings be upon our Prophet Muhammad and his family and his Companions.

Question:

In a Hadeeth, Allaah's Messenger (sallAllaahu `alayhi wa sallam) ordered that a woman who reaches puberty is forbidden from showing her hands and face, and that is the Hijaab. Is there any Hadeeth which indicate that covering the face and hands is also compulsory?

Answer:

In his Sunan, Abu Dawud recorded this Hadeeth in the chapter "What a Woman May Show Of Her Beauty." He said, "Ya'qub bin Ka'b Al-Antaki and Mu'mmal bin Al-Fadhl Al-Harani narrated to us, they said; Al-Walid narrated to us from Sa'id bin Bashir, from Qatadah, from Khalid, (Ya'qub said: 'Ibn Durayk') from 'Aishah, may Allaah be pleased with her, that Asma' bint Abu Bakr, may Allaah be pleased with her, entered upon the Messenger of Allaah (sallAllaahu `alayhi wa sallam) and she was wearing a very thin garment. The Messenger of Allaah (sallAllaahu `alayhi wa sallam) turned away and said,

يا أسماء إن المرأة إذ بلغت المحيض لم تصلح أن يري منها إلا هذا وهذا وأشار إلى وجهه وكفيه

"O Asma'! Indeed when a woman begins to menstruate, it is not correct to see from her except this and this." (Abu Dawud no. 4104)

And he pointed to his face and hands."

The Hadeeth is Mursal[1] because Khalid bin Durayk never met 'Aishah, may Allaah be pleased with her. Also, Sa'id bin Bashir Al-Azdi — or Al-Basri as he was originally from Al-Basrah — has been graded trustworthy by some of the scholars of Hadeeth, while Ahmad, Ibn Ma'in, Ibn Al-Madini, An-Nisa'i, Al-Hakim, and Abu Dawud all graded him weak. Muhammad bin 'Abdullah bin Numayr said about Sa'id: "His narrations of Hadeeths are Munkar (rejected), he is nothing," and: "He is not strong in Hadeeth, he narrates Munkar things from Qatadah." Ibn Hibban said, "His memory is poor and he makes enormous mistakes, narrating from Qatadah things that others do not." As-Saji said: "He narrated some Munkar things from Qatadah."

In this Hadeeth, he is narrating from Qatadah. Then, Qatadah is himself a Mudalis,[2] and he is narrating this Hadeeth from Khalid bin Durayk, while the chain also contains Al-Walid, who is, Ibn Muslim and he is a Mudalis, and his Tadlis is the same, and Qatadah is above him in the chain. So with all of this, it is clear that this Hadeeth is weak from many angles.

And with Allaah is the facilitation to do what is right. May Allaah send peace and blessings upon our Prophet Muhammad, his family and his Companions.

[1] A Mursal narration is one in which the link between the narrator and the Prophet (sallAllaahu `alayhi wa sallam) is not certain.

[2] A Mudalis is one who commits Tadlis. That is, narrating with wording that does not clearly convey whether he actually heard what he is narrating (say, "From" instead of "Narrated to us," or the like) or, distorting the name of the person he is narrating from so that it will not be obvious that he is narrating from someone whose narrations are disparaged.

حدثنا يعقوب بن كعب الأنطاكي ومؤمل بن الفضل الحراني قالا ثنا الوليد عن سعيد بن بشير عن قتادة عن خالد قال يعقوب بن دريك عن عائشة رضى الله تعالى عنها أن أسماء بنت أبي بكر دخلت على رسول الله صلى الله عليه وسلم وعليها ثياب رقاق فأعرض عنها رسول الله صلى الله عليه وسلم وقال يا أسماء إن المرأة إذ بلغت المحيض لم تصلح أن يري منها إلا هذا وهذا وأشار إلى وجهه وكفيه قال أبو داود هذا مرسل خالد بن دريك لم يدرك عائشة رضى الله تعالى عنها

The first question of Fatwa no. 4394
Q 1: What is the religious ruling on reciting the Qur’an collectively? Please support your answer with evidence from the Qur’an and Sunnah.
A: Reciting the Qur’an is an act of worship and one of the best Qurbahs (good deeds by which Allah's Pleasure is sought). The original principle regarding Qur’an recitation is that it should be according to the actual practice of the Prophet (peace be upon him) and his Sahabah (Companions of the Prophet, may Allah be pleased with them). It was not authentically reported from him or any of his Sahabah that they recited collectively; rather, each one of them would recite individually or one of them would recite and the others would listen. It was authentically reported that the Prophet (peace be upon him) said: Keep to my Sunnah (way) and to the Sunnah of the Rightly-Guided Caliphs after me. He (peace be upon him) said: Anyone who introduces anything into this matter of ours (Islam) that is not part of it will have it rejected. According to another narration: Anyone who does an action that is not in accordance with this matter of ours (Islam) will have it rejected.
It was reported that when the Prophet (peace be upon him) asked `Abdullah ibn Mas`ud (may Allah be pleased with him) to recite the Qur’an to him, he said: 'O Messenger of Allah, shall I recite the Qur’an to you when it has been revealed to you?' He (peace be upon him) said, 'I like to hear it from others.'

وثبت عن النبي صلى الله عليه وسلم أنه أمر عبد الله بن مسعود رضي الله عنه أن يقرأ عليه القرآن، فقال:  يا رسول الله أأقرأ عليك وعليك أنزل؟! قال: إني أحب أن أسمعه من غيري  .

The seventh question of Fatwa No. ( 7233 )
Q 7: is the Prophet (peace be upon him) authentically reported to have observed Sawm for the first ten days of Dhul-Hijjah?
A: It is not authentically reported that the Prophet (peace be upon him) observed Sawm the first ten days of Dhul-Hijjah - better described as the nine days preceding `Eid-ul-Adha (the Festival of the Sacrifice). However, he (peace be upon him) urged people to do good deeds during these days. The Prophet (peace be upon him) is authentically reported to have stated: "No good deed performed on other days are superior to those performed during these (first ten days of Dhul-Hijjah)."

Then some companions of the Prophet asked, "Not even Jihad?" He replied, "Not even Jihad, except that of a man who does it by putting himself and his property in danger (for Allah's sake) and does not return with any of those things."

ج7: لم يثبت فيما نعلم أن الرسول صلى الله عليه وسلم صام عشر ذي الحجة، أي: تسعة الأيام التي قبل العيد، لكنه صلى الله عليه وسلم حث على العمل الصالح فيها، فقد ثبت عنه صلى الله عليه وسلم أنه قال:  ما من أيام العمل الصالح فيها أحب إلى الله من هذه الأيام يعني: أيام العشر،

قالوا: يا رسول الله، ولا الجهاد في سبيل الله؟ قال: ولا الجهاد في سبيل الله إلا رجل خرج بنفسه وماله فلم يرجع من ذلك بشيء
