Marriage To One Who Commits Forbidden 

Sexual Intercourse: Sheikh Muhammad Ibn 

Saeed Raslaan

بسم الله الرحمن الرحيم

It is not permissible for a man to marry a woman that commits forbidden sexual intercourse, nor is it permitted for a woman to marry a man that does such, unless there occurs from both parties sincere repentance. The proof indicating this is the fact that Allah made chastity a condition found within all parties before the marriage. Just as He the exalted says:

اليومَ أُحلَّ لكم الطيبات و طعام الذين أُوتُو الكتاب حلٌّ لكم و طعامكم حلٌّ لهم و المحصنات من المؤمنات والمحصنات من الذين أُوتو الكتاب من قبلكم إذا ءَاتيتموهن أجورهن محصنين غير مسافحين و لا متخذي أحْدان

“This day the pure things have been made lawful for you. The people of the book’s food is lawful for you and yours is lawful for them. Likewise the chaste women from the believers and the chaste women from those given scripture before you when you give their bridal money (that being from) men desiring chastity, not committers of unlawful sex nor taking them as girlfriends…” [Al-Maa’idah: 5]

Also that which comes in His statement:

الزاني لا يَنْكِحُ إلاَّ زانيةً أو مشركة و الزانية لا يَنكحها إلاَّ زانٍ أو مشرك و حُرِمَ ذلك على المؤمنين

“The fornicator-adulterer does not marry except a fornicatress-adulteress or a idol worshiping woman. The fornicatress-adulteress no one marries her except a fornicator-adulterer, as the believers are forbidden from such. “[An-Nur: 3]

Allah forbade this. Prohibit upon the believing men is marriage to women that commit fornication and or adultery, as Allah orders chastity, and seeking the chaste woman and man. Thus forbidden upon the believer is marriage to whomever is described with committing prohibited sexual relations (fornication/adultery), or polytheism, because no one does that except a fornicator or polytheist, just as Allah Lord of the existence states.

As a result of this, you become aware that the affair, pertaining to the youth safeguarding their youthfulness, is tremendous. That is by him not involving himself in fornication, and the committing of immoral acts, likewise the young woman and the safeguarding of her youthful innocence. If this is the case, then it is a tremendous affair and a honorable gift.

Also the safeguarding of the woman after marriage, like we’ll see shortly. As Imam Ahmad held the opinion that if a woman committed adultery, while she has a husband, separation becomes binding. This affair will come shortly if Allah wills.

Imam Ahmad and Abu Dawud reported, with an authentic chain of transmission, upon the authority of Abu Huraira that Allah’s Messenger -sallahu alayhi wa sallam- said, “The whipped fornicator does not marry except one like him.” This narration is authentic.

The whipped fornicator: He who the Islamic punishment has been incurred upon.

Imam Ash-Shawkani said: “This description is commonly absent, pertaining to those that openly commit fornication and or adultery. In it is proof supporting the prohibition of a man marrying whomever openly commits forbidden sexual relations, likewise a woman marrying a man that does such. The previously mentioned verse alludes to this due to its last part, -and that is forbidden  for the believers.- Thus it is explicit as it relates to its prohibition.” 

It has not been made conditional that the Islamic penal punishment be inflicted upon him. On the contrary if he is known to commit prohibited sexual conduct, at this point it is prohibited for the believer to marry him off (to a believing woman). In addition if a woman is known to commit prohibit sexual relations, it is forbidden for a believer to marry her. This is the view of Qataadah, Ishaq, Ibn Ubayd, Ahmad, and Ibn Taymiyyah.

Not every statement of innovation makes one an innovator

In the name of Allah the Most Gracious the Most Merciful

Not every statement of innovation makes one an innovator!!!

By Shaykh Muhammad ibn Sa’eed Raslaan may Allah preserve him

The shaykh mentions this point in his book “Dawaabit at-Tabdee'” under the 18th chapter, “Muraa’atu al-Khata’i alladhi Ya’tari al-Bashar”. He says,

If a knowledgeable person is diligent in searching for the truth from the Book and Sunnah, makes every effort in seeking it, but makes a mistake in some issues of aqeedah, then he is not made to be an innovator and abandoned because of his mistake or mistakes. And if it said that his statement was a statement of innovation then it does not mean that he is a innovator. Just as (if someone) made a statement of disbelief; it does not necessitate that he is a disbeliever. Likewise, if someone makes a statement of innovation then it does not necessitate that he is to become an innovator.

Just as how making specific takfeer (calling someone a disbeliever) requires fulfilling conditions and mawaani’ the same goes for making tabdee’ (calling someone an innovator); it also needs to fulfill conditions and mawaani’.

“Make your motto the fear of Allaah…”


“Make your motto the fear of Allaah…”


“Here is the advice of a concerned friend, who sends it to you clothed and shaded in his desire to see good for you, and in the most eloquent and magical of words.”

Ibn al-Qayyim al-Jawziyyah (rahimahullah) says:

O you who seeks to save himself * Listen to the words of a loving advisor;
In all of your affairs, hold tightly to Revelation * And not to desirable hallucinations;
And give victory to the Book of Allah and the traditions *That came from the one sent with the Criterion;
And strike every denier with the sword of Revelation * Just like the Mujahid would strike over the fingertips;
And carry on with truthful zeal * The way of the sincere and brave who are dedicated to Allah;
And remain firm with patience under the banner of guidance * And if you are harmed in the process, it is for the Pleasure of the Merciful;
And make the Book of Allah and authentic traditions your weapons * And strengthen your soul;
Who will fight and present himself * Or compete on the battlefields?
Openly preach what the Messenger came with* And do not fear the lack of helpers;
And avoid two garments whose wearers* Will be censured and destroyed;
The garment of ignorance that comes with * The garment of partisanship – what terrible clothes!
And decorate yourself with fairness and justice * The best garment to beautify the chest and shoulders;
And make your motto the fear of Allah and advice of the Messenger
* And champion these two matters; And hold firmly to His rope and Revelation
* And depend on Him as He deserves…

When will Palestine be returned to us?–Shaikh Raslaan

 
In The Name of Allaah, The Most Merciful, The Bestower of Mercy
 
Shaikh Raslaan (may Allaah preserve him) said:
When will Palestine be returned to us?
 
When a Muslim in any place in the earth asks, ”When will Palestine be returned to us?” The answer is, ”If you return to Allaah (in correct belief, righteous action, obedience etc.), Palestine will be returned to you.”
 
This answer is derived from the statement of the Messenger (sallal-laahu-alayhi-wasallam) reported by Imaam Ahmad and Abu Dawood on the authority of Thawbaan (radiyallaahu-anahu) that the Messenger (sallal-laahu-alayhi-wasallam) said:
 
 ”The nations will soon call one another against you, just as people call one another to eat from a qas-a (i.e. a large plate of food). They asked: ‘’O Messenger of Allaah, is it because we will be few in number at that time? He (sallal-laahu-alayhi-wasallam) replied: No, you will be many in number at that time, but you will be Ghuthaa –(i.e. like the froth scum on the water). And Allaah will remove from the hearts of the enemies the fear they had for you and will place wahn in your hearts. They said: What is Wahn O Messenger of Allaah? He said: Love of the worldly life and having hatred for death.’’

If we return to Allaah (in correct belief, righteous actions, obedience etc.), He will returned to us what has been taken away away from us.
 
If we remain distant from Allaah (i.e. distant from the correct creed, righteous actions, obedience etc.), we will lose what is in our hands. And indeed Allaah (The Blessed and Most High) has made this judgement in His Tremendous Book, and He (The Most High) said:
 
وَإِذْ تَأَذَّنَ رَبُّكُمْ لَئِن شَكَرْتُمْ لَأَزِيدَنَّكُمْ ۖ وَلَئِن كَفَرْتُمْ إِنَّ عَذَابِي لَشَدِيدٌ
 
‘’And (remember) when your Lord proclaimed: “If you give thanks (by accepting Faith and worshipping none but Allah), I will give you more (of My Blessings), but if you are thankless, verily! My Punishment is indeed severe.”
 
[Soorah Ibraaheem: Ayah: 7]
 
He (The Blessed and Most High) clarified that being thankless for blessings bestowed (on us) will cause it to cease…. Our scholars say, ”Blessings are a prey and being thankful (for it) is the thing that makes (it) remain.
