“How can the believer be content to live in the land of the kuffaar where the rituals of kufr are proclaimed openly and rule belongs to someone other than Allaah and His Messenger seeing that with his eyes, hearing that with his ears and approving of it, and even starting to feel that he belongs there and living there with his wife and children, and feeling as comfortable there as he does in the Muslim lands even though he & his wife & children are in such great danger and their religious commitment and morals are in such peril?”

ADVICE OF SHAYKH IBN BAAZ TO A YOUNG MUSLIM LIVING IN ITALY




Shaykh Ibn Baaz رحمه الله wrote:

With regard to your letter in which you say that you are a young Muslim man living in Italy and that there are many young Muslim men there and that most of them responded to the crusaders’ wishes by keeping far away from the religion of Islam and its noble teachings, so most of them do not pray and they have bad morals and do evil deeds which they regard as permissible, and other things that you mention in your letter…

I advise you that living in a land in which shirk and kufr, and Christianity and other religions of kufr are prevalent, is not permissible, whether you are staying there for work, business, study or some other purpose, because Allah says (interpretation of the meaning):

“Verily, as for those whom the angels take (in death) while they are wronging themselves (as they stayed among the disbelievers even though emigration was obligatory for them), they (angels) say (to them): ‘In what (condition) were you?’ They reply: ‘We were weak and oppressed on the earth.’ They (angels) say: ‘Was not the earth of Allah spacious enough for you to emigrate therein?’ Such men will find their abode in Hell — what an evil destination!

Except the weak ones among men, women and children who cannot devise a plan, nor are they able to direct their way.

These are they whom Allah is likely to forgive them, and Allah is Ever Oft-Pardoning, Oft-Forgiving”

[al-Nisa’ 4:97-99]

And because the Prophet (peace and blessings of Allah be upon him) said:

“I have nothing to do with any Muslim who settles among the mushrikeen.”

This settling among the kuffaar is not done by one who knows the real meaning of Islam and faith, or who knows what Allah has enjoined upon the Muslims, or who is pleased with Allah as his Lord, Islam as his religion, and Muhammad (peace and blessings of Allah be upon him) as his Prophet and Messenger.

Being pleased and content with that means loving Allah, giving precedence to seeking His pleasure, being very concerned about following His religion and keeping company with His close friends, which means that one must completely disavow and keep far away from the kaafirs and their lands. Rather, faith as defined in the Qur’an and Sunnah cannot coexist with these evils.

It is narrated in a saheeh report from Jareer ibn ‘Abd-Allaah al-Bajali (may Allah be pleased with him) that he said: O Messenger of Allah, accept my oath of allegiance and stipulate conditions.

The Messenger of Allah (peace and blessings of Allah be upon him) said:

“Worship Allah, establish regular prayer, pay zakaah, be sincere towards the Muslims and keep away from the mushrikeen.”

Narrated by Abu ‘Abd al-Rahmaan al-Nasaa’i.

It is also narrated in a saheeh report that the Messenger of Allah (peace and blessings of Allah be upon him) said: “I have nothing to do with any Muslim who settles among the mushrikeen.” And he (peace and blessings of Allah be upon him) said: “Allah will not accept any deed from a mushrik after he becomes Muslim until he leaves the mushrikeen.”

The scholars have clearly stated that this is not allowed, and have warned against it, and stated that it is obligatory to migrate if one is able, except for a man who has knowledge and insight, and goes there to call people to Allah and bring people forth from darkness into light, and explain the teachings of Islam to them. A verse in Soorat al-Tawbah – (interpretation of the meaning):

“Say: If your fathers, your sons, your brothers, your wives, your kindred, the wealth that you have gained, the commerce in which you fear a decline, and the dwellings in which you delight are dearer to you than Allah and His Messenger, and striving hard and fighting in His Cause, then wait until Allah brings about His Decision (torment). And Allah guides not the people who are Al-Faasiqoon (the rebellious, disobedient to Allah)”

[al-Tawbah 9:24]

– indicates that seeking worldly gains is not a legitimate shar’i excuse, rather the one who does that is a faasiq (rebellious evildoer) who is subject to the warning of not being guided if these matters, or some of them, are dearer to him than Allah and His Messenger, and jihad for the sake of Allah. What good can there be in seeing shirk and other evils and keeping quiet about them, or even doing them, as has happened to some of those whom you mentioned who are supposedly Muslim?

If the Muslim who settles there claims that he has some worldly aims such as study, business or work, that is even worse.

In the Book of Allah there is a stern warning against merely failing to migrate (hijrah), as in the verses of Soorat al-Nisa’ quoted above, where Allah says (interpretation of the meaning):

“Verily, as for those whom the angels take (in death) while they are wronging themselves”

So how about the one who travels to a kaafir land and agrees to settle there? As you mentioned, the scholars (may Allah have mercy on them) forbade settling and going to a land where the Muslim will not be able to practice his religion openly. The one who is there for study, business or work come under the same ruling as the one who settles there, if they are not able to practice their religion openly and they are able to migrate.

As for the claim of some of them that they hate them and despise them, yet they are settling in their land, that is not sufficient, rather it is haraam to travel and settle there for many reasons, including the following:

1. It is not possible to practice the religion openly in a way that means one has discharged one’s duties fully.

2. The texts and clear statements of the scholars (may Allah have mercy on them) indicate that if a person does not know his religion with its evidence and proof, and he is not able to defend it and ward off the specious arguments of the kaafirs, it is not permissible for him to travel to their land.

3. One of the conditions of it being permissible to travel to their land is that one should be safe from the fitnah of their power, control, specious arguments and attractions, and be safe from imitating them or being influenced by their actions.

4. Blocking the means that may lead to shirk is one of the most important principles of Islam. Undoubtedly, what you mention in your letter about things that happen with Muslim youth who settle in these lands is the result of their staying in the land of kufr. They should be steadfast in adhering to their religion, practicing it openly, following its commands, heeding its prohibitions, and calling others to it, until they are able to migrate from the land of shirk to a Muslim land.

Allah is the One Whom we ask to set straight all your affairs and to bless you with understanding of His religion and make you steadfast in following it. May He help us and you and all the Muslims to do all that He loves and that pleases Him, and to protect us and you and all the Muslims against things that may lead us astray and against the tricks of the shaytaan. May He help us to do all that is good, and support His religion, and make His word supreme, and reform the leaders of the Muslims and bless them with understanding of His religion, and help them to rule according to the sharee’ah of Allah in their lands, and refer to it for judgement, and be content with it and beware of that which goes against it, for He is able to do that. Peace be upon you and the Mercy of Allah and His blessings.

من عبد العزيز بن عبد الله بن باز إلى الأخ المكرم (ن.م) وفقه الله لما فيه رضاه وزاده من العلم والإيمان آمين، سلام عليكم ورحمة الله وبركاته، أما بعد:

فإشارة إلى رسالتك التي تذكر فيها أنك شاب مسلم تقيم في إيطاليا، وأن بها شباباً من المسلمين كثيرين، وأن أغلبهم استجاب لرغبة الصليبيين في إبعادهم عن دين الإسلام وتعاليمه السامية، فأصبح أغلبهم لا يصلي، وتخلق بأخلاق سيئة، ويعمل المنكرات ويستبيحها.. إلى غير ذلك مما ذكرته في رسالتك. 


وأفيدك بأن الإقامة في بلد يظهر فيها الشرك والكفر، ودين النصارى وغيرهم من الكفرة لا تجوز، سواء كانت الإقامة بينهم للعمل أو للتجارة أو للدراسة، أو غير ذلك؛ لقول الله تعالى إِنَّ الَّذِينَ تَوَفَّاهُمُ الْمَلائِكَةُ ظَالِمِي أَنْفُسِهِمْ قَالُوا فِيمَ كُنْتُمْ قَالُوا كُنَّا مُسْتَضْعَفِينَ فِي الْأَرْضِ قَالُوا أَلَمْ تَكُنْ أَرْضُ اللَّهِ وَاسِعَةً فَتُهَاجِرُوا فِيهَا فَأُولَئِكَ مَأْوَاهُمْ جَهَنَّمُ وَسَاءَتْ مَصِيرًا * إِلا الْمُسْتَضْعَفِينَ مِنَ الرِّجَالِ وَالنِّسَاءِ وَالْوِلْدَانِ لا يَسْتَطِيعُونَ حِيلَةً وَلا يَهْتَدُونَ سَبِيلًا * فَأُولَئِكَ عَسَى اللَّهُ أَنْ يَعْفُوَ عَنْهُمْ وَكَانَ اللَّهُ عَفُوًّا غَفُورًا[1]، ولقول النبي صلى الله عليه وسلم: ((أنا بريء من كل مسلم يقيم بين أظهر المشركين))[2]، وهذه الإقامة لا تصدر عن قلب عرف حقيقة الإسلام والإيمان، وعرف ما يجب من حق الله في الإسلام على المسلمين، ورضي بالله رباً، وبالإسلام ديناً، وبمحمد صلى الله عليه وسلم نبياً ورسولاً. فإن الرضا بذلك يتضمن من محبة الله، وإيثار مرضاته، والغيرة لدينه، والانحياز إلى أوليائه ما يوجب البراءة التامة والتباعد كل التباعد من الكفرة وبلادهم، بل نفس الإيمان المطلق في الكتاب والسنة، لا يجتمع مع هذه المنكرات، وصح عن جرير بن عبد الله البجلي رضي الله عنه أنه قال: يا رسول الله بايعني واشترط، فقال له رسول الله صلى الله عليه وسلم: ((تعبد الله وتقيم الصلاة وتؤتي الزكاة وتناصح المسلمين وتفارق المشركين))[3] أخرجه أبو عبد الرحمن النسائي، وصح عن رسول الله صلى الله عليه وسلم الحديث السابق، وهو قوله عليه الصلاة والسلام: ((أنا بريء من كل مسلم يقيم بين أظهر المشركين))، وقال عليه الصلاة والسلام: ((لا يقبل الله عز وجل من مشرك عملا بعدما أسلم؛ أو يفارق المشركين))[4]، والمعنى حتى يفارق المشركين. وقد صرح أهل العلم بالنهي عن ذلك، والتحذير منه، ووجوب الهجرة مع القدرة، اللهم إلا رجل عنده علم وبصيرة، فيذهب إلى هناك للدعوة إلى الله، وإخراج الناس من الظلمات إلى النور، وشرح محاسن الإسلام لهم، وقد دلت آية سورة براءة: قُلْ إِنْ كَانَ آبَاؤُكُمْ وَأَبْنَاؤُكُمْ وَإِخْوَانُكُمْ وَأَزْوَاجُكُمْ وَعَشِيرَتُكُمْ وَأَمْوَالٌ اقْتَرَفْتُمُوهَا وَتِجَارَةٌ تَخْشَوْنَ كَسَادَهَا وَمَسَاكِنُ تَرْضَوْنَهَا أَحَبَّ إِلَيْكُمْ مِنَ اللَّهِ وَرَسُولِهِ وَجِهَادٍ فِي سَبِيلِهِ فَتَرَبَّصُوا حَتَّى يَأْتِيَ اللَّهُ بِأَمْرِهِ وَاللَّهُ لا يَهْدِي الْقَوْمَ الْفَاسِقِينَ[5] على أن قصد أحد الأغراض الدنيوية ليس بعذر شرعي، بل فاعله فاسق متوعد بعدم الهداية إذا كانت هذه الأمور أو بعضها أحب إليه من الله ورسوله، ومن الجهاد في سبيل الله، وأي خير يبقى مع مشاهدة الشرك وغيره من المنكرات والسكوت عليها، بل وفعلها، كما حصل ذلك من بعض من ذكرت من المنتسبين للإسلام. وإن زعم المقيم من المسلمين بينهم أن له أغراضاً من الأغراض الدنيوية، كالدراسة، أو التجارة، أو التكسب، فذلك لا يزيده إلا مقتاً. وقد جاء في كتاب الله سبحانه وتعالى الوعيد الشديد والتهديد الأكيد على مجرد ترك الهجرة، كما في آيات سورة النساء المتقدم ذكرها، وهي قوله تعالى: إِنَّ الَّذِينَ تَوَفَّاهُمُ الْمَلائِكَةُ ظَالِمِي أَنْفُسِهِمْ[6] الآيات97 وما بعدها. فكيف بمن يسافر إلى بلاد الكفرة، ويرضى الإقامة في بلادهم، وكما سبق أن ذكرت أن العلماء رحمهم الله تعالى حرموا الإقامة والقدوم إلى بلاد يعجز فيها المسلم عن إظهار دينه، والمقيم للدراسة أو للتجارة أو للتكسب، والمستوطن حكمهم وما يقال فيهم حكم المستوطن لا فرق، إذا كانوا لا يستطيعون إظهار دينهم، وهم يقدرون على الهجرة.

وأما دعوى بغضهم وكراهتهم مع الإقامة في ديارهم فذلك لا يكفي، وإنما حرم السفر والإقامة فيها لوجوه، منها:

1- أن إظهار الدين على الوجه الذي تبرأ به الذمة متعذر وغير حاصل.

2- نصوص العلماء رحمهم الله تعالى، وظاهر كلامهم وصريح إشاراتهم أن من لم يعرف دينه بأدلته وبراهينه، ويستطيع المدافعة عنه، ويدفع شبه الكافرين، لا يباح له السفر إليهم.

3- من شروط السفر إلى بلادهم أمن الفتنة بقهرهم وسلطانهم وشبهاتهم وزخرفتهم، وأمن التشبه بهم والتأثر بفعلهم.

4- أن سد الذرائع وقطع الوسائل الموصلة إلى الشرك من أكبر أصول الدين وقواعده، ولا شك أنما ذكرته في رسالتك مما يصدر عن الشباب المسلمين الذين استوطنوا هذه البلاد هو من ثمرات بقائهم في بلاد الكفر، والواجب عليهم الثبات على دينهم والعمل به، وإظهاره، واتباع أوامره، والبعد عن نواهيه، والدعوة إليه، حتى يستطيعوا الهجرة من بلاد الشرك إلى بلاد الإسلام. والله المسئول أن يصلح أحوالكم جميعاً، وأن يمنحكم الفقه في دينه والثبات عليه، وأن يعينكم على الهجرة من بلاد الشرك إلى بلاد الإسلام، وأن يوفقنا وإياكم وجميع المسلمين لكل ما يحبه ويرضاه، وأن يعيذنا وإياكم وسائر المسلمين من مضلات الفتن ومن نزغات الشيطان، وأن يعيننا جميعاً على كل خير، وأن ينصر دينه، ويعلي كلمته، وأن يصلح ولاة أمور المسلمين ويمنحهم الفقه في دينه، وأن يوفقهم لتحكيم شريعة الله في بلادهم، والتحاكم إليها، والرضا بها، والحذر مما يخالفها، إنه ولي ذلك والقادر عليه، والسلام عليكم ورحمة الله وبركاته.

“However, if there exists from the women she who is rational, and resolute, and possesses insight and comprehension, and is able to travel and leave the land of disbelief to go to the land of Islaam, and she feels safe for herself from fitnah (tribulation), then this woman, it is obligatory upon her to leave and make hijrah when she is in the circumstance where it is obligatory upon her, and it is not a condition that she have a mahram (a guardian who, because of ties, she is never able to marry) because of the statement of Allah,تعالى :

( يا أيها الذين آمنوا إذا جاءكم المؤمنات مهاجرات فامتحنوهن )

” O you who believe, when believing women come to you as emigrants examine them, “(Al-Mumtahanah:10)

For verily Umm Kulthoom bint Uqbah ibn Abee Mu’ait left, and also Zainab the daughter of the Messenger of Allah,صلى الله عليه و على آله و سلم, left, they both left without a mahram, and likewise many women left from Makkah to Madeenah without mahrams, so the hadeeths which mention the condition of having a mahram for a woman to travel don’t apply in the particular case of hijrah.”

HIJRAH WITHOUT A MAHRAM

Question 182: There is a woman whose family members are not committed to the Qur’an and the Sunnah, and they do not support her with (wearing) the hijaab and being steadfast upon the deen. She has a nine years old son. So, is it correct for him to be her mahram, (such that) she travels with him to an Islamic country or other than it because she and her son want to seek knowledge?

Answer 182: If she intends Hijrah then it is permissible for her to travel as a Muhajirah (one who is performing Hijrah) even if without a mahram, like Umm Kulthum bint Uqbah ibn Abee Mu’eet travelled (for Hijrah) and like Zainab, the daughter of the Messenger of Allah sallallahu alayhe wa sallam travelled.

Also if she does not intend Hijrah but she intends to run away from fitnah then that is permissible for her as well, because in it (running away from fitnah) lies the meaning of Hijrah.

As for the Hadeeth: “It is not permissible for a woman to travel except with a mahram,” it remains on its general ruling and its exception is what is entailed in Hijrah, Allahu Musta’aan!

And as for the son, we did not mention him because the people are differ, from among people are some who are (mentally) matured and he is only nine years old, and from the people are those who are immature even though they have reached the age of 13 or more, so people differ in their (mental) maturity.

In any case, it is permissible for her. And it is compulsory on her to fear Allah subhaanahu wa ta’aala and she should not speak to any of the passengers except women and let her not be a source of fitnah to others. Allahu Musta’aan!

We Need Salafy Schools or We Need to Leave!

Brother Abu Mu'aawiyyah shared these notes from today's tele-link:

Shaykh Abu Abdul'Alaa Khalid 'Uthmaan al-Misree (hafidhahullah) said,

"Protecting Our Children's Muslim Identity.... It is obligitory for Muslims upon the sunnah in the west to get together and form a school, or gather together in one location, to teach the Qur'aan and Sunnah and have our children intermingle with one another. The Shaykh said Imaam Malik has a statement that it is not permissible to send our children to the non-muslim to even learn reading and writing. This is because the non-muslims will exert all their efforts and energy to influence our children into their creed, beliefs and behaviour.

The Shaykh (hafidhahullah) said, "...If the Salafis find it difficult to establish their own schools, then it is upon them to hasten to make hijrah!"

The questions were read to him by sheikh Abu Abdil A’laa, though the questions were mainly around Hajj there was one question that was relevant and that the questioner asked saying I am an Algerian who has taken up residence in the UK and I married a European woman.  She had embraced Islam then after a period she apostate and has gone with my children and I am unable to get my children from her what is your advice?
The sheikh responded by saying this is a punishment and recompense to you from Allah for taking up residence in the lands of shirk! Then he mentioned advice to the questioner and all who have taken up residence in the lands of the kufaar for the purpose of obtaining the dunya is to return to their Muslim lands. For indeed the affair is very dangerous and we have seen may of their offsprings apostate from Islam. Those who migrate to those lands it is a must that apostacy will overcome them or some of their offsprings, and this is an affair that is known and observed .  So seek your sustenance from Allah For Allah Says: “Indeed Allah is The Sustainer, the possessor of great might” know that what Allah has written for you from provisions will never pass you. So we believe that Allah he is the provider and that what is written in the preserved tablet will not change, neither will our provisions pass us. And it is possible that one may live in the lands of the disbeliever poor and disgraced, doing menial labour such as toilet cleaning and the like! Indeed the Muslim is noble and honourable.
Allah says: “But Honor power and glory belong to Allah, His messenger and the believers, but the hypocrites know not” (Suratul Munaafiqqoon Vs 8)
Thus the believer should be noble, have richness in his heart and live in his own land the lands of Islaam, where he can nurture his children upon the book of Allah and the Sunnah of the messenger of Allah – Sallallahu alaihi wa salam
He mentioned that we are truly sorry to hear about your children and that you should try what you can to get them back into your custody
Those were some brief note on yesterdays sitting and I will endeavour to summarise todays sitting tomorrow inshallah

Question: “I want to ask a question about hijrah. I live in England, a non-Muslim country. The British government does not give me any problems about going to the mosque to pray, there are no problems for me with work or anything else. Is it obligatory upon me to make hijrah or can I stay here and also call the people to Islaam?”


Shaykh al-Albaani (rahimahullaah) answers:
“This is an important question, especially with regard to the one who used to be a disbeliever then Allaah guided him and he became Muslim. And we frankly say that it is obligatory upon evey Muslim in every spacious land of Allaah – if Allaah guides him to Islaam after he was a disbeliever – to make hijrah from that country to a Muslim country where the rulings of Allaah, ‘azza wa jal, are established, because the Prophet (sallAllaahu ‘alayhi wa sallam) used to say: ‘The fires of a Muslim and a mushrik[1] should not come into each other’s views.’[2] In this authentic hadeeth, he (‘alayhi ssalaat wa ssalaam) was indicating what the Arabs – particularly those who were Bedouins – used to do before Islaam, when each one of them used to light a fire in front of his tent. So he (sallAllaahu ‘alayhi wa sallam) is saying that a Muslim’s dwelling must be far from that of a mushrik, such that if each of them were to light a fire in front of his tent, the fire of one of them would not show to the other one due to the far distance between them. This is the meaning of his (‘alayhi ssalaam) statement: ‘The fires of a believer and a mushrik should not come into each other’s views.’


And another hadeeth mentions: ‘Whoever mixes with a mushrik, then he is like him,’ meaning whoever mixes with them with his body, dwelling and association, and is like that most of the time, then he is like him in misguidance, even if the proportion of misguidance differs, as is the case with eemaan (belief); so just like eemaan has levels, misguidance also has levels. So whoever mixes with a mushrik, he is like him. Then, he (‘alayhi ssalaat wa ssalaam) emphasized that with an expression which contains a severe alarm, which is his (‘alayhi ssalaat wa ssalaam) statement: ‘I am free from every Muslim who resides among the mushriks.’[3] And the reason for that is from the aspect that (one’s) natural disposition is to take on (the characteristics one is surrounded by), especially as he takes on evil and does not absorb good except with difficulty. And the Prophet (sallAllaahu ‘alayhi wa sallam) has indicated this reality in some authentic narrations such as his (sallAllaahu ‘alayhi wa sallam) statement: ‘The righteous companion is like the seller of musk, he will either give you (some) free of charge, or you will buy from him, or you will smell a pleasant scent from him.’[4] He (‘alayhi ssalaat was ssalaam) means that if a Muslim mixes with righteous people, he will take on (good) from them, definitely, and the lowest level of (this) acquirement in this example is that he will smell a pleasant scent from him. And vice versa, he (‘alayhi ssalaam) said: ‘The evil companion is like the blacksmith (who blows the bellows), he will either burn your clothes or you will smell a foul smell from him.’[5] 

In short, this hadeeth means that a companion is someone who pulls – if he is righteous, he will pull his associate toward good, and if he is evil and corrupt, he will pull his associate toward evil.
Then the Messenger of Allaah (sallAllaahu ‘alayhi wa sallam) narrated to us an example that happened in one of the nations before us, so he (‘alayhi ssalaat wa ssalaam) said: ‘There was a man from those before you who killed ninety-nine people then wanted to repent, so he asked about the most knowledgeable person of the land and was led to a worshiper – but he was ignorant and not a person of knowledge. So he went to him and said: ‘I killed ninety-nine people and I want to repent, so is there any repentance for me?’ He replied: ‘You killed ninety-nine people and want to repent?! There is no repentance for you.’ So this killer did nothing but kill him and thus he completed the hundredth person that he killed with no right. However, he was serious about returning to his Lord and repenting to Him, so he continued asking about the most knowledgeable person of the land until this time he was led to a true person of knowledge. So he asked him and said: ‘I have killed a hundred people with no right, so is there any repentance for me?’ He replied: ‘And who is coming between you and repentance? But – {and here is the point} – you are in an evil land, so depart from it and go to such-and-such town whose people are righteous.’ So he left his town – going on as he repented to his Lord – toward that town with righteous people, considering the fact that the person of knowledge had advised that. And on the way, his appointed time of death arrived. So the angels of mercy and the angels of punishment differed with regard to him, each side claiming that they are entitled to him; the angels of punishment knew the widespread evil of his life, and therefore they deemed that they should take his soul, and the angels of mercy deemed as the Messenger (‘alayhi ssalaat wa ssalaam) said in another hadeeth: ‘actions are based on the last ones,’[6] and this man left repenting to his Lord so we – the angels of mercy – are entitled to taking his soul.


So Allaah sent them an arbitrator, who said to them: ‘Measure (the distance) which is between him and each of the two towns, and whichever one he is closer to, connect him with its people.’ So they measured and found him to be closer to the town with righteous people… So the angels of mercy took his soul.[7] And the point taken from this authentic hadeeth, which is in the two Saheehs: al-Bukhaari and Muslim, is that this distinguished person of knowledge knew and indicated that this man – whose boldness led him to killing ninety-nine people before, who then completed the number by (killing) that ignorant worshipper, such that those whom he killed with no right became a hundred people – that this soul commanding evil was only helped upon that by the environment in which he lived and spent most of his life, and thus (the person of knowledge) advised him to move from that evil land to a righteous town.

…And we know that the one who lives in the lands of the disbelievers, even if he used to be a disbeliever before (and not anymore), that he (still) cannot escape the effects of that evil environment except by being removed from there completely and travelling to the lands of the Muslims

Therefore, it has been mentioned in the Noble Qur’aan that when the angels take the soul of the disbeliever who did not migrate to the lands of the Muslims nor believe in Islaam: ‘Was the earth of Allaah not spacious enough for you to emigrate therein?’[8] So hijrah is a tradition that has been followed since old times and its underlying reason is so a Muslim can preserve his religion.


…And hijrah is only from the lands of disbelief to the lands of Islaam, or in some cases it could be from the lands of disbelief to another country of disbelief but where religious freedom is better than (the former). As for the lands of Islaam, they are present now, all praises be to Allaah, and therefore whoever is a true Muslim, it is obligatory upon him to abandon his disbelieving country and make hijrah to his Muslim country, because the Muslim country includes all of the lands of Islaam, and there is no intolerance among the Muslims and adapting oneself to a particular region. 

 So whichever country in which a Muslim settles, it is his country; and by that, he would preserve his Islaam, concerning the new Muslim, and on the other hand, he would develop himself, nourish himself, and be able to cultivate himself and his relatives with other Islaamic manners. As long as we talk about those Muslims residing in the lands of disbelief, (we say) from where do they learn Islaam? They can’t learn Islaam and its rulings, how does he deal with his wife, his children, his neighbors, and correct his ‘aqeedah (creed) before everything else? He cannot do that except by making hijrah.


Thus, the Islaamic legistation – the Qur’aan and the Sunnah – has ordered the Muslim to abandon the lands of disbelief for the lands of Islaam.

Question 11: The Muhaajir returning to the Land he made hijrah from to visit relatives

What is the ruling of the Muhaajir returning to the land which he made hijrah from the purpose of visiting relatives, and what is the condition for that?

The Answer:

It is not permissible for the Muhaajir to return to his land for the purpose of visiting relatives because of what has preceded, except if he made his main purpose be to call them to Islaam if they are disbelievers and he hopes they will embrace Islam, and there is no other way to call them except going to them and meeting them directly.

Something like that is alright, however, with the condition that he feel safe for himself from tribulation, and also he must be qualified to call them whereas he has knowledge of his deen with evidences, and also he is familiar with that which his relatives are in need of for him to call them over there. I is alright in this situation for him to go for a couple of days whereas he does not leave the ruling of a traveller, without residing nor settling.

Likewise, if his relatives are disobedient Muslims, so he goes to call them to leave with the previous condition. However, we point out that if they are Muslims and he is able to arrange a meeting with them in the land of Islaam, like at Hajj and ‘Umrah, then that would be a good thing.

Also, we remind our brothers who have made Hijrah about the danger of returning to the lands of disbelief after making Hijrah from them, for verily the person, it is possible that he might long for staying there and forget that he has made hijrah from it, and he could become weak in his faith and in-turn, desire to remain there.

Also, in the hadeeth of Abu Sa’eed which has been transmitted by the two Shaykhs on the Prophet (sallallaahu Alayhi wa sallam), the hadeeth about that person from the children of Isra’eel who killed one hounded people then when he was guided to that Scholar who he asked for his legal opinion, he then gave the verdict that there is repentance for him and he said to him, “and don´t return to your land, for verily it is a land of evil”. So it is upon he who has left those to beware and not return to them in order that he does not turn weak, and that his intention does not change, and Allah is the one whose help is sought.
 
Question 12: The Muslim going to the lands of disbelief to visit relatives and acquire citizenship
 

What is the ruling on the Muslim from his land to the lands of the disbelievers for the purpose of visiting relatives, and what is the condition for that, and what is the ruling on the person in this situation going to obtain the citizenship of the disbelievers?

The Answer:

The answer to is similar to the answer previous question; primarily, it is not permissible of the main purpose for goings is to call them under condition previously mentioned, then it is alright.

As for if the purpose for traveling is to obtain the citizenship of the disbelievers, then it has all the more reason to be forbidden than that which has preceded, and, praise be to Allah, the people of knowledge have given the legal verdict that it is forbidden to acquire the citizenship of the disbelievers because of what that includes, from being under their control and falling under their rule of law.
