Chapter 331


Prohibition of Describing the Charms of a Woman to a man without a valid reason approved by the Shari'ah

1742. Ibn Mas`ud (May Allah be pleased with him) said: The Messenger of Allah (sallallaahu ’alayhi wa sallam) said, "No woman should touch another woman's body and then describe the details of her figure to her husband in such a manner as if he was looking at her.''
[Al-Bukhari]. 


Commentary: "Mubashirah'' means "meeting of two bodies'' and here it signifies that one should not see another person's body. Here, it is used in its literal as well as metaphorical sense. What it really means is that neither a woman should see the body of any other woman nor should she touch her own body with the body of some other woman, for if she does so, she will come to know the physical qualities of the other woman which she may disclose to her husband. Such disclosures may induce her husband to mischief and eventually ruin her own life. One is allowed, however, to disclose a woman's charms to a man who intends to marry her. 


It is prohibited for a woman to describe another woman to her husband.

The Messenger of Allah (peace be upon him) said: "...and she describes her to her husband as if he were looking at her. " [Bukhari]

This type of description has many dangers; among them is that love for the other woman might enter the husband's heart, and so he starts wishing that he was with the other woman that is described to him, instead.

(and not to reveal their adornment except to their husbands, or their fathers, or their husband's fathers...), "The paternal uncle and maternal uncle are not mentioned here, because they may describe a woman to their sons, so a woman should not remove her Khimar in front of her paternal or maternal uncle.''With regard to the husband, all of this is for his sake, so she should try her best when adorning herself for him, unlike the way she should appear in front of others.
(or their women,) this means that she may also wear her adornment in front of other Muslim women, but not in front of the women of Ahl Adh-Dhimmah (Jewish and Christian women), lest they describe her to their husbands. This is prohibited for all women, but more so in the case of the women of Ahl Adh-Dhimmah, because there is nothing to prevent them from doing that, but Muslim women know that it is unlawful and so, would be deterred from doing it. The Messenger of Allah said:

(No woman should describe another woman to her husband so that it is as if he is looking at her.) It was recorded in the Two Sahihs from Ibn Mas`ud.

قال البخاري - رحمه الله تعالى - (9/ 338 ) : حدثنا محمد بن يوسف، حدثنا سفيان، عن منصور، عن أبي وائل، عن عبدالله بن مسعود - رضي الله عنه - قال: قال رسول الله صلى الله عليه وسلم: " لا تباشر المرأة المرأة؛ فتنعتها لزوجها كأنه ينظر إليها ".

لا تباشر: قال الطيب في شرح " مشكاة المصابيح ":

البشرة: ظاهر جلد الإنسان

والمباشرة: الملامسة، وأصله من لمس البشرة البشرة

والمعنى به في هذا الحديث النظر مع اللمس

فينظر ظاهرها من الوجه والكفين

ويحس باطنها باللمس

ويقف على نعومتها وسمنها. اهـ


قال القابسي: هذا أصل لمالك في سد الذرائع فإن الحكمة من النهي خشية أن يُعجِب الزوج الوصف المذكور، فيفضي ذلك إلى تطليق الواصفة أو الافتتان بالموصوفة. مرجع كلام القابسي " الفتح " (9/338)

Question: There is a group amongst us (in Britain) called Muntadaa Al-Markaz Al-Islaamee. They are connected with Muhammad Suroor and they sell his books and interact with him. And they have a tazkiyah (approval/recommendation) from Shaikh ‘Abdul-‘Azeez Ibn Baaz and Shaikh Ibn ‘Uthaimeen that encourages cooperating with them and being connected to them. So what is your advice to Al-Muntadaa Al-Islaamee and what is your advice to the Salafees who cooperate and work with them in Da’wah?
Answer: My advice to them is that they return to the condition they were upon when they were spreading the Qur’aan and Sunnah in their magazine “Al-Bayaan” and in their magazine “As-Sunnah”. We were extremely pleased with the magazine “As-Sunnah” and likewise with the magazine “Al-Bayaan”. But then the reality became clear – that they were in fact Hizbees (partisans), who called people away from the scholars.
And I advise them to not clash with the Muslim rulers. This partisanship (hizbiyyah) has caused divisions within the unity of the callers to Allaah from among the Ahlus-Sunnah in Yemen, and in the lands of the Haramayn, Najd and in Sudan and in Egypt, as well as in many of the Muslim countries.
They call people to not have any concern for knowledge. There used to be a group of students that was studying with us, then they attached themselves to these people, and all of sudden they started to have contempt for their brothers (other students) and for us.
Studying the Qur’aan and the Sunnah to them is like a seashell (i.e. it is hollow and empty). And performing worship in the masjid to them is also like a seashell. And these are the masaajid, about which the Prophet (sallAllaahu ‘alayhi wa sallam) said: “If one of you makes wudoo (ablution) and he does it well, then he goes out to the masjid – nothing brings him out except the prayer, he does not take one step except that Allaah raises him one level due to it and one sin gets erased from him. So when he prays, the angels do not stop sending their prayers upon him, as long as he is in prayer, saying: ‘O Allaah, bless him, O Allaah, have mercy on him.’ And none of you ceases to be in prayer while he is waiting for the (next) prayer.”
So I say: If Shaikh Ibn Baaz and Shaikh Ibn ‘Uthaimeen gave tazkiyah (approval) to Al-Muntadaa before the Gulf Crisis, then they are both excused from that, because even we ourselves praised the magazine “Al-Bayaan” a lot, and we called people to cooperate in working with them. And if they gave their tazkiyah after the Gulf Crisis – and I don’t think that is so – then they are both considered to be in error. So I say to the two Shaikhs: These people have split the Muslims here in Yemen and they have turned to attacking and showing enmity to the Ahlus-Sunnah. Rather, their harm has become great – and I do not say that their harm is greater than that of the Ikhwaan al-Muslimeen – for they are only like scraps as compared to the Ikhwaan al-Muslimeen. And they are the ones who transgress against many of the masaajid of Ahlus-Sunnah, amongst which is a masjid in ‘Aden, the masjid of the people in Buraiqah, which Shaikh Ahmad Ibn ‘Uthmaan is the Imaam of…
So if these two Shaikhs issued a tazkiyah (religious approval), then they should take it back, just as I took mine back when their affair became clear to me during the Gulf Crisis, and when their enmity became apparent to me in Yemen. And from their heads is ‘Abdul-Majeed Ar-Reemee, Muhammad Al-Baydaanee and ‘Abdullaah Ibn Faysal Al-Ahdal. They have begun mocking and ridiculing their brothers. And if you were to read the Qasaa’id (poetic verses) of ‘Abdul-Majeed you would have found them according to the Sunnah, but now they have diluted and melted away.
So I advise the mashaayikh to recant form their approvals (tazkiyaat), for Allaah says in His Noble Book: “And do not argue on behalf of those who deceive themselves. Verily, Allaah does not like anyone who is a betrayer, sinner.” [Surah An-Nisaa: 107]
And He says: “Have you not seen those who claim sanctity for themselves (i.e. given themselves tazkiyahs). Nay, but Allah sanctifies whom He wills. And they will not be dealt with unjustly, even equal to the extent of a fateel (small thread).” [Surah An-Nisaa: 49]
And He says in His Glorious Book: “So do not purify (give tazkiyah to) yourselves, He knows best who has Taqwaa.” [Surah An-Najm: 13?]
And they use this tazkiyah (approval) for the purpose of deceiving the people, so it is not acceptable if it is used for this time, because it has become clear from them that they attack Shaikh Al-Albaanee and that they criticize Shaikh Ibn Baaz, when he issued a fatwa allowing the treaty with the Jews during the Gulf Crisis. And they rejoice at this so that they can chase the people away from the scholars, because no one has remained with them! So they say: “We have no choice for these people, except to attack their scholars, because we (ourselves) are scholars.” And if their Shaikh opposes them he suddenly becomes from the Takfeeri group!
They invited Abu Suhaib, who was Syrian, to teach amongst them. So after he taught amongst them for as long as Allaah willed, they said: “We feel that the fruits of your teaching should be repaid to you, so pick any land and we will give you the proper permits. So he responded: “The lands belong to Allaah and do not belong to you. Cut off the salary you pay me because I don’t want it.” Then the students remained with him and all praise be to Allaah not one student was produced from them. Even though they are troublemakers, still by Allaah’s Grace, they have no effect. So I advise the Salafi brothers to stay far away from these Hizbees (partisans), because they are not looking for anything except to build the membership of their party.
And if ‘Aqeel Al-Muqtaree comes to you, or Muhammad Al-Mahdee or other than these two, and the people say: “This is a scholar from the scholars of Yemen”, then do not host him or allow him entry. And do not attend his lectures, because he only goes touring around for the sake of collecting dollars!
And one brother who came from America informed me that they were touring through America, giving lectures, and they would say: “The one who supports an orphan and me are like this!”[1] So a man from the crowd stood up – and he was looking for aid for Bosnia and Herzog – and said: “The one who supports the orphan is the one who feeds him not the one who begs.” So they began to dispute with one another all because of the worldly matters (Duniyaa)!
When worldly aspirations enter into the Da’wah, it’s blessing diminishes, as Allaah says: “Does not the sincere worship belong to Allaah?” [Surah Az-Zumar: 3] And He says: “And they were not commanded except to worship Allaah, making their worship (Religion) sincerely to Him (alone).” [Surah Al-Bayyinah: 5]
As for their magazine of begging, which we call “Al-Furqah” (causing divisions) Magazine, and which they call “Al-Furqaan” (The Criterion), then I challenge them to bring any of its issues which doesn’t have begging in it. And I challenge Muhammad al-Mahdee to bring forth a student of knowledge that can be studied under. Rather, you find that he has transformed ‘Abdullaah Ibn Ghaalib, Muhammad Al-Baydaanee and many others, for they used to be students of knowledge here (in Yemen), but then he deluded them and misled them!
And I forgot to mention Muhammad Al-Hadeeyah who came charging from Sudan to Riyadh, then to Jeddah, then to Qatar and then to Abu Dhabi, then to Dubai, all for the purpose of building a masjid for the Sufis!
So I advise you to stay far away from these individuals! And perhaps someone may say: “So then who should we study under?” So my response is: I hold that it is an obligation on our noble brothers in the lands of the Haramayn and Najd to send to their brothers some people (to teach them) who are not Hizbees (partisans). And it is an obligation on us also, to send to our brothers in England some of our students who can be studied under, even if they stay for three or five months.
Therefore I say: It is an obligation to turn our attention to the Qur’aan and the Sunnah. As for the lectures of the innovators, then you will see them stampeding and ramming (like wild beats) in their lectures, but then when they finish, they say: “We have a project for establishing an educational center.” And this educational center is in the district of Daleel.
So I advise the brothers – may Allaah preserve them – to request from Shaikh Ibn Baaz – may Allaah preserve him – that he send to them someone that can teach them. And I advise my brothers here (in Yemen), that one of them should go to (them) and stay for three months, then return and someone else go. This does not fall into the realm of advice only; rather I consider it to be an obligation. But I don’t mean that a brother should arrive at England and then they waste his time by traveling around or that he doesn’t find students who want to seek knowledge from him. So they must learn some Arabic, ‘Aqeedah (Creed), Islamic Fiqh and Hadeeth of the Prophet (sallAllaahu ‘alayhi wa sallam).

"The Jews and Christians say that they do not suffer from the problem of waswas (conscious whispers).He replied,' They are speaking the truth;for what would Satan want with a house that is ruined?"

Beer Gold drinks

The question:


Recently, a drink called Beer Gold appeared in the market. It is said to be free from alcohol. In fact, people talk a lot about this drink, but most of them do not know if it is permissible or not to drink it and sell it.

So, we hope that our virtuous Sheikh Abu `Abd Al-Mu`iz to clear us the ruling regarding this question. May Allah reward you with best, protect you and grant you a long life so that people can benefit from your knowledge.      

The answer:

All praise is due to Allah, the Lord of the Worlds. Peace and blessing be upon whom Allah sent as a mercy to the Worlds, upon his Family, his Companions and his Brothers till the Day of Resurrection.

It is known that wine is prohibited because it is intoxicating. So, intoxication is the reason of prohibition; and the existence of this ruling depends on the existence of this reason. That is to say, if intoxication exists, prohibition exists too; and if intoxication does not exist, there is no prohibition. 

Grape juice, for instance, is permissible before fermentation and being intoxicating; but when it ferments, it is prohibited; and when it turns into vinegar, it becomes again permissible and the prohibition is removed because its nature has changed and it is no more intoxicating. Indeed, this ruling of prohibition regards all drinks when they are intoxicating; otherwise, they are permissible.

Consequently, the drink stated in the question has the same aforementioned ruling, given that it is not intoxicating. Nevertheless, since such drink is known among people to be intoxicating and the person who consumes it is a drunk, and lest the Muslim might be suspected if he consumes it, or he might think, while drinking it, that he drinks an intoxicating wine; this drink is prohibited for all those reasons, and in order to keep the Muslim above any suspicion, to consider him as a pious person and to prevent him from thinking about wrong things that may have a bad influence on his behavior.

Finally, we deduce that, as a rule, this drink is not prohibited because it does not contain any intoxicating component. However, the prohibition is occasional, in order to obstruct the ways [which lead to commit what is unlawful], to keep considering people as pious persons, to keep them above suspicion and to protect souls from satanic inspirations, so that they will not fall into the nets and the traps of devils and the soul that commands to do evil deeds.    
               
The perfect knowledge belongs to Allah عزّ وجلّ. Our last prayer is all praise is due to Allah, the Lord of the Worlds. Peace and blessing be upon our Prophet, his Family, his Companions and Brothers till the Day of Resurrection.

في حكم مشروبات «بيرقولد»

السؤال: لقد ظهرت في المدة الأخيرة نوع من المشروبات التي تسمى بـ:(bieregold) ويقال إنّها خالية من المادة الكحولية، فكثر فيها الكلام، وكثر فيها القيل والقال، وأشكل الأمر على كثير من الناس حكم شربها أو بيعها، فنرجو من شيخنا الفاضل أبي عبد المعز أن يبين لنا الحكم في هذه المسألة، وجزاكم الله خيرا وحفظكم الله ورعاكم وأطال عمركم ونفع بكم.
 
الجواب: الحمد لله رب العالمين والصلاة والسلام على من أرسله الله رحمة للعالمين وعلى آله وصحبه وإخوانه إلى يوم الدين أمّا بعد:
فالمعهود في تحريم الخمر إنّما هو لإسكارها والسكر علة التحريم ويدور معها وجودا وعدما، فمتى وجد الإسكار وجد التحريم وإذا انتفى ينتفي معه الحكم، فإنّ عصير العنب قبل تخميره وحلول الإسكار فيه جاز، وإذا تخمر حرم، ثمّ إذا تخلل انتفى عنه حكم التحريم لتغير حقيقته وزوال الإسكار عنه، وهذا حكم عام لسائر المشروبات التي يطرأ عليها الإسكار فيحرمها وإلاّ فلا.
فالمذكور في السؤال لا يخرج حكمه عمّا ذكرنا لانتفاء الإسكار عنه، غير أنّه لمّا كان هذا المشروب مشتهرا عند العامة بوصف الإسكار وأنّ متعاطيه سكران، ولمّا كانت خشية تهمة المسلم لاصقة به إذا ما شربه، أو يخطر بباله حال شربه له أنّه يشرب خمرا مسكرا منع من ذلك سدا لذريعة التهمة وحمله على الصلاح ودفعا لما يخطر بباله من المفاسد التي قد تؤثر على سلوكه.
فالحاصل أنّه لا تحريم يرد على هذا المشروب بالنظر إلى خلوه عن مسكر في الأصل وإنّما المنع قد يرد عارضا من باب سد الذرائع وحمل الناس على الصلاح وإبعادهم عن التهمة وتجنب النفس الوساوس الشيطانية لئلا يقع في مصايد وشراك الشياطين والنفس الأمارة بالسوء.
والله أعلم وآخر دعوانا أن الحمد لله رب العالمين وصلى الله على محمد وعلى آله وصحبه وإخوانه إلى يوم الدين وسلم تسليما.

"When people praise you, people are trully praising Allaah's hijab (screen) which He screened your sins with. As-Sateer (The Concealer) is from Allaah's Names."

What to say when praised

Allaahumma laa tu'aakhithnee bimaa yaqooloona, waghfir lee maa laa ya'lamoona [waj'alnee khayram-mimmaa yadhunnoon].

Translation: O Allaah , do not call me to account for what they say, and forgive me for what they have no knowledge of [and make me better than they imagine].

None of them attributed it to the Messenger of Allaah (sallallaahu 'alayhi wa sallam), so it seems to be that the best-case scenario is that it is from Aboo Bakr and then some of the taabi'oon and those after them.

Questioned posed to the Allaamah Shaykh Zayd al-Madkhalee (may Allaah preserve him):

Q. Noble Shaykh, how can the believer stay away from showing off in his actions and is the praise of the people for him because of his worship something that can harm him?

A. "The actions are based upon the intentions. Therefore the one who has been praised by the people for the action of good and he didn't do the action except seeking the pleasure of Allaah, the praise of the people does not harm him. Their praise of him is actually a testimony from them for that which he i upon and this doesn't harm him. If he senses something in his heart of amazement when he is praised by the people or when he hears the one who praises him, it is upon him to turn to Allaah azza wa jall and it is upon him to say the narrated supplication on the Prophet (sallallaahu alayhi wa sallam): 

"Allaahumma Innee A'oodhu Bika An Ushrika Bika Shay-an 'A lamuhu Wa As-tagh-firuka Limaa T'alam"
 
-Oh Allaah indeed I seek refuge with you that I associate anything with you that I am aware of. And I seek Your forgiveness for that which You know.-

With the permission of Allaah that which is in the heart of weakness or amazement will leave with might of Allaah and His power."

Shaytaan beautifying disobedience and sin

In the story of Aadam shaytaan beautified disobedience for him


He said,


“O Aadam! Shall I lead you to the Tree of Eternity and to a kingdom that will never waste away?” [6]


He said,


“Your Lord did not forbid you this tree save that you should become angels or of the immortals.” [7]


Indeed the life of humankind is limited as to its strength and man strives to prolong both which are openings for shaytaan into the should of man whereby he can enter and beautify disobedience to him.


In the battle of Badr shaytaan beautified the deeds of the polytheists for them:


“And be not like those who come out of their homes boastfully and to be seen of men, and hinder (men) from the Path of Allaah. And Allaah is encircling and thoroughly comprehending all that they do. And (remember) when shaytaan made their (evil) deeds seem fair to them and said, `No one of mankind can overcome you this Day (of the battle of Badr) and verily, I am your neighbor (for each and every help).’ But when the two forces came in sight of each other, he ran away and sad, `Verily, I have nothing to do with you. Verily! I see what you see not. Verily! I fear Allaah for Allaah is Severe in punishment.’[8]


The cores of satanic beautification are false promises and glimmering hopes. Just as Aadam (alayhi as-sallam) was promised eternal life and rule likewise were the polytheist promised victory;


“He (shaytaan) makes promises to them, and arouses in them false desires; and shataan’s promises are nothing but deception.” [9]


Satanic beautification has a numbing effect because it is veiled with compassion , sympathy and love. He swore to Aadam (alayhi as-sallam) and his wife that he was their sincere advisor;


“And he (shaytaan) swore by Allaah to them both (saying): `Verily, I am one of the sincere well-wishers for you both’ [10]


This is the sunnah of shaytaan which Ibless and his party have been pursuing against (Bani Aadam) the children of Aadam (alayhi as-sallam) for centuries.


He did this to Aad and Thamud;


“And Aad and Thamud! And indeed their destruction is clearly apparent to you from their (ruined) dwellings; Shaytaan made their deeds fair-seeming to them, and turned them away from the (Right) Path, though they were intelligent” [11]


He also deceived Sheeba and her kingdom;


“I found her and her people worshipping the sun instead of Allaah, and shaytaan has made their deeds fair-seeming to them, and has barred them from Allaah’s way so they have no guidance.” [12]


It was also the case with Quraish during a military raid at (the battle of) Badr, as mentioned before.


This has been his way with every nation throughout every century;


“By Allaah, we indeed sent (Messengers) to the nations before you [O Muhammad (alayhi as-sallam)] but shaytaan made their deeds fair-seeming to them. So he (shaytaan) is their Wali (friend, protector and helper) today theirs will be a painful torment.” [13]


And the Saying of Allaah,


“Ibless said `O my Lord! Because you misled me, I shall indeed adorn the path of error for them (mankind) on the earth, and I shall mislead them all. Except Your chosen, (guided) slaves among them.” [14]


Ibless establishes the courtyard of his battle on earth using his tools of beautification ­ beautification of ugliness. The gullible see his false attraction and it leads them to sin.


Thus man does not commit evil nor perpetuate disobedience except that shaytaan beautifies it for him in shades and colours showing him a false reality and its wickedness. So the people should be warned that whatever a matter appears beautiful to them or whenever they find a longing desire in themselves, shaytaan will already be there.


From this we can look to the prophetic guidance on the issue of a Muslim’s behavior with the opposite sex, when for example a man sees a woman whom he becomes attracted to.


On the authority of Aboo Kubshah al-Anamazee who said;


The Messenger of Allaah (alayhi as-sallam) entered upon his companions then left and performed ghusl (then he, alayhi as-sallam, returned after performing ghusl), so we said “O Messenger of Allaah (alayhi as-sallam), what happened? He (alayhi as-sallam) replied: `So- and- so passed by me and a desire for women entered into my heart so I went to some of my wives and had relations with her, so you should do likewise, for the best of actions which you can do is go to what is lawful.’” [15]


So women are the ropes of shaytaan, perhaps shaytaan beautifies acts of disobedience for man, so one must try to subdue shaytaan and drive away his deception. This has come from the clear Sunnah. The Messenger of Allah (alayhi as-sallam) said;


“Indeed the woman appears in the form of shaytaan and leaves in the form of shaytaan. So if one of you should see a woman who he likes, then he should go to his family and that will repel what is in him.” [16]


Thus the sunnah uncovers the reality which shaytaan aims to obliterate when he beautifies an unlawful action for man. When explaining about the tongue some poets say;


“If they say it is forbidden then say too, it is forbidden, Aah! But the delectations lie in the forbidden”


The Prophet (alayhi as-sallam) said;


“Whenever a man sees a woman who he becomes attracted to then he should go and stay with his wife, for indeed there is within her the like of the first.” [17]

The Effect of Shyness upon Finding a Good Husband

Oh Muslim Sister!


All praises belong to Allah may the peace and blessings of Allah be upon our Prophet Muhammad and upon his family, companions and those who follow his guidance.

In an effort to find a suitable spouse some of our Muslim sisters often resort to impermissible, demeaning methods such as free-mixing with men via the internet, chat rooms, marriage websites, social networks, sending pictures and the like.

Unfortunately some of our sisters have been deceived into believing this to be the more effective technique for obtaining a spouse, removing from themselves the veil of shyness, modesty and dignity.

Oh my sister in Islam! Trust in Allah and follow the blessed methodology of Islam when choosing a mate.

Shaykh Salih Fawzan explains how Allah rewards the shy and modest woman with a good husband.

The Shaykh said…

Allah the Exalted said concerning the story of Musa,alayhi wa sallam:

And when he arrived at the watering (place) in Madyan, he found there a group of men watering (their flocks), and besides them he found two women who were keeping back (their flocks). He said: "What is the matter with you?" They said: "We cannot water (our flocks) until the shepherds take back (their flocks): and our father is a very old man."

Until the statement of the Exalted:

Afterwards one of the women came (back) to him, walking upon bashfulness. She said: "My father invites you that he may reward you for having watered (our flocks) for us." (Chapter 28: 23-25)

So the bashfulness of these two women prevented them from crowding with the men at the watering hole, rather they waited until a shepherd appeared until they were able to water their flock without crowding with the men.

And when their father sent one of them to Musa to request him to meet with their father; she came to Musa alayhi wa sallam upon bashfulness.

The result was that Allah the Exalted chose her as a spouse for His Messenger, the one He spoke to directly, Musa alayhi wa sallam. This was the result of her holding firm to shyness and bashfulness and being far away from mixing with men.

As Allah the Exalted said:

"Women of purity are for men of purity, and men of purity are for women of purity". (Chapter 24:26) This story appears in the Noble Quran to be taken by the believing women as a righteous example until the Day of Judgment.

Informing The Authorities Of Terrorist Plots.

The Salafi position with regarding those who incite or plan terrorist acts such as suicide, kidnap or bombings is that Muslims should inform the authorities of their activities. This is regardless of whether these acts are perpetrated in Muslim or non-Muslim countries. Muslim communities must be at the forefront of stamping out these non-Islamic acts that are done falsely in the name of Islam. The Messenger of Allaah stated: “Whoever sees an evil, let him change it with his hand. If he is not able to do that, then let him change it with his tongue . And if he is not able to do that, then let him with his heart, and that is the weakest of faith.” (Reported by Muslim)

The Scholars have stated that forbidding with the hand is done by the governments and the authorities, so they hold and punish and imprison the evil doers. If they withhold from this duty, it does NOT fall into the hands of the citizens to take the law into their own hands. Rather they remain patient. As for speaking against the evil in terms of refuting the false ideologies, then that it for the scholars and the people of knowledge, not for ignorant, and there has never been a time in the history of Islam, except that the scholars have spoken out against evil ideologies and doctrines as a safeguard for Islam, and this will not stop up until the final Hour is established. As for the general person then he forbids only in accordance to his knowledge and ability in line with the rulings of the true scholars of the Sunnah based upon the Qur’aan and the Sunnah. As for hating with the heart, then this for the one who recognizes evil, but does not have the knowledge nor the ability to speak against this, so he distances himself from it and keeps away from it. So as it relates to the terrorists, then it is known by the one possessing knowledge as well as the one who is devoid of it, that these acts are evil and condemned by the Muslim scholars based upon the texts of the Qur’aan and authentic Sunnah. So both, the one possessing knowledge and the general person, informs the authorities of those that incite or plan terrorist acts.

And this is from the aspect of forbidding evil and thereby earning the reward of Allaah, the Most High. Indeed it is a distinguishing trait of this nation that they enjoin the good and forbid the evil. Allaah states, “Let there rise from amongst you a group that call to good and they enjoin the good and forbid the evil. And indeed they are the successful.” (Qur’aan 3:104) Indeed nations that came before were cursed upon the tongues of the Prophets due to them not forbidding the evil when it appeared. Allaah, the Most High, states, “Those amongst the Children of Israel were cursed by the tongue of Dawood (David) and Eesaa the son of Maryam (Jesus son of Mary), because they used to transgress the bounds. They used not to forbid one another from evil which they committed…” (Qur’aan 5:78-79).

So Muslims should take heed from this great verse. Additionally the Messenger of Allaah (salallaahu alaihi wassallam) stated: “There are not a people amongst whom sins are committed, and they are stronger than those who commit them yet they do not prevent them, except that Allaah sends His punishment upon them all.” (See Tashabbuhul-Khasees of adh-Dhahabee, and the hadeeth is authentic) Another reason why these terrorists and their ideology must be stamped out is due to the fact that they are innovators who have attributed to Islaam, that which is Islam is free of, and it is impermissible to accommodate them or defend them or protect them, due to the statement of the Prophet (salallaahu alaihi wassallam), “Whoever innovates or accommodates an innovator, then upon him is the curse of Allaah, His Angels and the whole of mankind.” (Reported by Bukhaaree and Muslim). And there is not a shadow of a doubt from an Islamic perspective, that these terrorist ideologies are innovations and these perpetrators are innovators, and it is not permissible to protect them or give them refuge.


One can recognize the ideology of the these evil doers from certain matters that their lectures and discussions always revolve around, from them is that they always call for rebellion and revolution in the Muslim lands and against the Muslim rulers; they declare the Muslim rulers and those who work in the apparatus of government to be apostates and unbelievers; they praise the suicide bombers and terrorists and insurgencies in Iraaq, Palestine and other places and continually justify their actions; they may praise the bombings of 9/11 in New York, 7th July bombings in London or the Madrid bombings. These discussions of theirs may not necessitate that they themselves will organize or carry out terrorist acts but this speech of theirs incites others towards violence. Remember it only takes two or three young men (or women) who have been affected to go out and wreak havoc. The Messenger of Allaah (salallaahu alaihi wassallam), mentioned these renegades (known as the Khawarij) in a narration, “If I am alive when they appear, I will slaughter them with the slaughtering of Aad.” And Aad was a tribe mentioned in the Qur’aan that was punished by Allaah for their evils and transgressions. He also stated, “They are the worst of Allaah’s creation under the sky.” There are many, many other narrations of the Prophet and his Companions describing them, to the extent that Shaikhul-Islaam Ibn Taymiyyah and Imaam an-Nawawee, two great scholars of the middle ages, stated the consensus of the great Scholars of the Salaf and Sunnah that these renegades must be prevented and fought against. In fact Shaikhul-Islaam Ibn Taymiyyah (died 728 AH) stated that the Khawaarij are more harmful to Islaam and the Muslims than the Jews and the Christians. And this is due to the fact that these Jihaadis, Takfeeris and terrorists are a cancer within the ranks of the Muslims, destroying the purity of the Religion from within.


So when one looks at the activities of these people such as the killing of men, women and children, Muslim and non-Muslim alike, one sees that they are indiscriminate in their murderous acts. After what has been mentioned above one can see why the Scholars of this noble and blessed Salafi da’wah have issued verdicts calling people to inform the authorities if they know of anyone inciting or planning terrorist acts.

There is NO doubt that those make a link between terrorism and what they term as ‘The Wahhaabis’, intending by that the Salafis, have made a mythical link based upon fallacies and falsehood. The great Scholar Muhammad Ibn ‘Abdul-Wahhaab (died 1206AH), after whom his adversaries invented the derogatory term ‘Wahhaabi’ for anyone who studied his works - then this Scholar was the most fervent in his opposition to deviation and deviant ideologies. Rather the Salafis, whom the opposers term as Wahhaabis, have been at the forefront of combating the takfeeri, Jihaadi and Khariji ideologies, for decades. And this refutation of the Salafi scholars upon these groups was not just a mere response to modern-day events but rather a religious obligation upon them regardless of prevailing circumstances.

So Syed Qutb, the father and reference point of the modern-day Jihadist-terrorist movements, was refuted by the Salafi Scholars for his call to assassinations and violent revolution decades ago and again in the early nineties by the likes of the Salafi scholars such as Shaikh Bin Baaz, Shaikh Bin Uthaimeen and especially in great detail by Shaikh Rabee bin Haadee al-Madkhalee who authored several books in exposition of Syed Qutb. Shaikh Bin Baaz warned and exposed the evil doctrine of Usamah bin Laden back in the early nineties, whilst the Islamic political groups were in praise of him. Sayyid Abul Ala Maududi is another reference point for the modern day violent politically motivated groups, yet the Salafi Scholars such as Shaikh Rabee al-Madkhali, Shaikh Ubaid al-Jaabiree, Shaikh Hammaad al-Ansaaree exposed his errors and warned against his approach. Another example is the warning of the Salafi Yemeni Scholar Muqbil bin Haadee against the HAMAS of Palestine whilst the latter were supporting terrorist attacks on civilian buses in Israel. We also have the Scholarly Salafi stance against Hizbollah of south Lebanon and former leader of Iran, Khomeini such as the statements of Shaikh Bin Baz, Shaikh Bin Uthaimin, Shaikh Ahmad an-Najmi and others. Shaikh Ibn Uthaimeen in his now published explanation of ‘Riyaadhus-Saaliheen’ well over fifteen years ago showed his clear abhorrence at the suicide bombings in Palestine. So this is the clarity with which the Salafis speak and have always spoken. Over a thousand years of Salafi authorship, from the time of the disciples of the Prophet until this day, the Scholars of Sunnah and Salafiyyah have been refuting the false ideologies, whether extremist or negligent - Whereas the people of deviation will respond based upon political expediency, but the underlying ideology in support of revolution and suicide attacks remains. How is it possible to be straddle both sides of the fence in this issue, whilst the Qur’aan and Sunnah is so clear upon them?

What is astonishing is that these same people accuse the Salafis, whom they call Wahhaabis, of being responsible for these false extremist ideologies. It reminds us of the lines of poetry: “She accused me of the illness she possessed, and then slipped way!”

Question:

Is it permissible to inform the disbelieving authorities about another Muslim who is deviant in his methodology and understanding of Islam since that person will cause harm to the Muslim society and the society at large?


Answer:

In times of trials like this in which we are in, If a Muslim is asked about the condition of another Muslim, that Muslim who he’s being asked about is upon a way or methodology that is different from what Islam came with like killings and attacking without just cause then it upon that person who is asked to say that which he knows about those people. He should say the truth openly. Because in that there is a prevention of these types of attacks and killings that take place which oppose the way of Islam. At the same time by doing so, the person being asked removes doubts from himself in the minds of those people. Such that, if he had hidden anything they would have considered him to also to be a terrorist in the same way. The actions of the Khawaarij or killing people without cause and just reason or destroying companies and buildings, this has nothing to do with Islam in the slightest. As for the proof that some people use by saying that whoever transgresses against you then you transgress against them similarly, this is with regard to two people similar in status rather your Lord says “And if you forgive then this is closer to piety.”  And He also says “And if he forgives then his reward is with Allaah.” On top of that we all see the results of these types of attacks and these types of unjustified killings and the way that it has brought harm to the Muslims. Maybe even bad thoughts and misunderstanding about Islam in itself.

Is it Betrayal to Turn the Terrorists in to the Authorities?1

Question: Honorable Shaykh, some of the youth come sometimes and ask about this issue: if I find someone who defends these people (the Khawaarij, terrorists, etc.) and their plots, should I turn them in and inform (the authorities) of them? Some people consider this to be a form of betrayal on the part of the authorities, and that it’s impermissible to do this. We hope your eminence will explain this.


Answer: The prophet (sallallahu alayhi wa sallam) said:


“The religion is sincerity (giving sincere advice).”

He repeated this three times. We (the companions) asked, “To whom, messenger of Allaah?” He answered:

“To Allaah, His book, His messenger, to the leaders of the Muslims and their common people.”2

So, anyone who falls into these issues, he should be sincerely advised and explained the reality of these matters. If he desists, then thanks are due to Allaah. If he doesn’t desist yet he keeps quiet and doesn’t actually do anything, then leave him – his sin is upon himself. But

if he actually and outwardly does something to deceive other Muslims or always talks about it, spreading this filthy ideology, then it’s an obligation to turn him in. This is a part of being sincere to Allaah, His book, His messenger, to the Muslim leaders and the common people.

Raaqi to touch non Mahram woman?

Is it permissible for the raaqi to touch a non mahram woman when doing ruqyah?

Many people are suffering from diseases for which they cannot find medical treatment, so they turn to the Book of Allaah and the scholars and some pious and righteous people who have memorized the Book of Allaah, so that they can recite ruqyah as prescribed by sharee’ah to treat them.

The site of women’s pain may be in their heads, chests, arms or legs – is it permissible for them to uncover these places so that they may be read over in cases of necessity? What are the limits within which women may uncover when Qur’aan is read over them for this purpose?


Answer:

Praise be to Allaah.

It is Sunnah to learn ruqyah as prescribed in sharee’ah, seeking to benefit the Muslims and treat these chronic diseases, because the Book of Allaah is a beneficial healing.

But it is not permissible for a non-mahram man to touch any part of a woman’s body when doing ruqyah, and it is not permissible for her to uncover any part of her body such as her chest, neck, etc.

He should recite over her even if she is covered, and this will be of benefit no matter where the pain is. It is also Sunnah for some of the sisters who can read Qur’aan to be taught how to do ruqyah so that they can use it to help modest women. And Allaah knows best.

Imam ibn Qudamah al-Maqdisi (d.620H) eloquently and poetically said:

Allah described Himself with al-’Uluww fi’s-Sama


And He was described with this by the seal of the Anbiya,


And this was agreed upon by all of the ‘Ulama – from the pious Sahabah and fuqaha,


Narrations have been reported about this with yaqeen


And these have been accepted in hearts of the Muslimeen,


And this is a naturally instinctive belief in all creation,


So when a calamity befalls them they look to the heavens and raise their hands making supplications,


And they wait for succour to arrive from the Creator of creations,


And they pronounce this upon their tongues,


And this is only rejected by an extremist innovator, who is steeped in his deviance,


Or one tested by uncritical following of him in his misguidance.

Satan has three ways of tempting man:


One: Increase and extravagance; to have more than one needs. This addition is the way, which Satan uses to enter the heart. To protect oneself from that is to be careful not to fulfill all the needs of the soul like food, sleep, pleasure, or rest. Whenever you close this door, you would be safe from any enemy.


Two: Negligence; whoever remembers Allah is protected by the fortress of remembering Him. When he neglects that he will be opening the door of this fortress and the enemy will enter. It would then be difficult to drive him out.


Three: Caring for what is not his business in all matters of life.

Among the Causes of the Transgression
of the Jinns were that Humans
sought Refuge with Them


Allah says,


(And verily, there were men among mankind who took shelter with the males among the Jinn, but they increased them in Rahaq.) meaning, `we used to think that we had some virtuous status over mankind because they used to seek refuge with us whenever they (men) would settle in a valley or any place in the wilderness, the open country steppes and other places.’


This was the custom of the Arabs in the pre-Islamic days of ignorance. They used to seek refuge with the greatest Jinn of a particular place so that no harm or evil would afflict them. Like one would do if he entered into the land of his enemies, in the vicinity of a great and powerful man, he would seek the protection and guardianship of that man. So when the Jinns saw that the humans were seeking refuge with them due to their fear of them, they increased them in Rahaq which means fear, terror and fright. They did this so that the people would be more afraid of them and seek refuge with them even more. As Qatadah said concerning this Ayah, (but they increased them in Rahaq.) means, “the Jinns were courageous and increased in insolence against them.”




As-Suddi said, “A man used to set out with his family (on a journey) until he came to a piece of land where he would settle. Then he would say, `I seek refuge with the master (Jinn) of this valley from the Jinns, or that myself, my wealth, my child or my animals are harmed in it.”


Qatadah said, “When they sought refuge with them instead of Allah, the Jinns would overcome them with harm because of that.”


Ibn Abi Hatim recorded from `Ikrimah that he said, “The Jinns used to fear humans just like humans fear them, or even worse. So whenever humans would come to a valley the Jinns would flee. So the leader of the people would say, `We seek refuge with the leader of the inhabitants of this valley.’ So the Jinns said, `We see these people fleeing from us just like we flee from them.’ Thus, the Jinns started coming near the humans and afflicting them with insanity and madness.”


Thus, Allah said, (And verily, there were men among mankind who took shelter with the males among the Jinn, but they increased them in Rahaq.) meaning, in sin. Abu `Aliyah, Ar-Rabi` and Zayd bin Aslam, all said, (in Rahaq) “This means in fear.” Mujahid said, “The disbelievers would increase in transgression.”
