When the Scholar Talks, and When He is Silent

It is reported that Al-Fuḍayl b. ʿAyyāḍ – Allāh have mercy on him – said:

The true faqīh (scholar) is the one who the fear of Allāh makes talk and the fear of Allāh makes silent. If he speaks it is by the Book and the Sunnah, and if he is silent, it is by the Book and the Sunnah. And if something is confusing to him and unclear, he withholds judgement and refers it back to whoever knows about it.

"Indeed Allah does not remove the knowledge by removing it from the hearts of the people, but he removes the knowledge by the death of the scholars. Until no scholar remains, so the people take the ignorant as their religious leaders, so they will ask them for rulings, and they will give verdicts without knowledge, so they will stray, and lead others astray."

 WHO DO YOU ASK FOR ADVICE?

The person who has a secret, as we previously described, should tighten his chest, but if he feels he must share his secret, he should do so by consulting someone who is religious, intelligent, and beloved, and he should never seek advice from someone who does not possess these three characteristics. If he is not religious, he will betray him; if he is not intelligent, then he will make a mistake regarding the correct course; and if he is not loved, then he may not give him sincere advice.

In The Name of Allaah, The Most Merciful, The Bestower of Mercy.

[يَـٰقَوۡمِ إِن كُنتُمۡ ءَامَنتُم بِٱللَّهِ فَعَلَيۡهِ تَوَكَّلُوٓاْ إِن كُنتُم مُّسۡلِمِينَ – And Musa (Moses) said: “O my people! If you have believed in Allah, then put your trust in Him if you are Muslims (those who submit to Allah’s Will). [10:84]; Meaning: Place your trust in Allaah, return to Allaah by asking for steadfastness, aid, assistance, victory etc. Then Allaah [The Most High] says that Moosaa’s [alayhis-salaam] people replied, saying: [فَقَالُواْ عَلَى ٱللَّهِ تَوَكَّلۡنَا رَبَّنَا لَا تَجۡعَلۡنَا فِتۡنَةً۬ لِّلۡقَوۡمِ ٱلظَّـٰلِمِينَ – They said: In Allah we put our trust. Our Lord! Make us not a trial for the folk who are Zalimun (polytheists and wrong-doers (10:85)]; Meaning: Do not allow them to overpower us and thus we are put to trial in the affairs of our religion, or that they are given victory and thus we are put to trial and they say, “Had they (i.e. the believers) being upon the truth, they would not have been defeated. [وَنَجِّنَا بِرَحۡمَتِكَ مِنَ ٱلۡقَوۡمِ ٱلۡكَـٰفِرِين – And save us by Your Mercy from the disbelieving folk. (10:86)]; Meaning: Save us from their evil, so that we can practice our religion in the correct manner it should be practised- by establishing its laws and being able to manifest it without being opposed or prevented.

Then Allaah [The Most High] says that He commanded Moosaa and Haaroon [alayhimas-salaam], saying: [ وَأَوۡحَيۡنَآ إِلَىٰ مُوسَىٰ وَأَخِيهِ أَن تَبَوَّءَا لِقَوۡمِكُمَا بِمِصۡرَ بُيُوتً۬ا وَٱجۡعَلُواْ بُيُوتَڪُمۡ قِبۡلَةً۬ وَأَقِيمُواْ ٱلصَّلَوٰةَ‌ۗ وَبَشِّرِ ٱلۡمُؤۡمِنِينَ – And We inspired Musa (Moses) and his brother (saying): “Take dwellings for your people in Egypt, and make your dwellings as places for your worship, and perform As-Salat (Iqamat-as-Salat), and give glad tidings to the believers].

So when the trial became severe and they faced increased persecution at the hands of Fir’awn and his chiefs, Allaah [The Most High] commanded Moosaa and Haaroon (alayhimas-salaam] to command the believers to take dwellings in which they can perform the prayer when they are unable to perform it their places of worship; for indeed the prayer is an aid in all affairs. And besides this, they were given glad tidings that they will be given victory and that a time is coming in which they will be able to manifest their religion; for ease will come after a period of hardship.

The Value of Most People’s Judgements

It is reported that Mālik b. Dīnār – Allāh have mercy on him – said:

Since I have come to know people, I do not rejoice when they praise and I do not dislike it when they blame, for those that praise go to excess in praise and those that blame go to excess in blaming. When the scholar learns knowledge in order to act, it humbles him; but if he learns it for something other than action, it only makes him more boastful.

It is reported that Abū Ḥāzim Salamah b. Dīnār – Allāh have mercy on him – said:

You cannot be a scholar unless you have three traits: you do not transgress against those above you, you do not look down on those lesser than you, and you do not take any dunyā in return for your knowledge.

بسم الله الرحمن الرحيم

Q: Is the opinion of the majority (of scholars) deemed ijmaa (consensus)?

A: No, the majorities’ opinion is not considered as consensus, it is only deemed as the majorities’ opinion and that’s it. For this reason the four Imams (whenever they all agreed on a matter) it was not said about them they had consensus on the contrary it would be said that they agreed. The four imams had agreement in such and such an issue however it is not said a consensus (among all scholars). An agreement (among the four) is not a consensus (among all the scholars).

Are Not Affected by Astray Ideologies!




In highlighting the reason why some of the youth diverge away from the correct methodology, Shaikh Saalih Al-Fawzaan (hafidhahullaah) explains how detaching from the scholars and from their guidance whilst allowing oneself instead to be influenced by deviant ideologies is the cause of divergence from the truth:




The Shaikh states:




“These youth who have diverged away from the Salafi manhaj (methodology) in da’wah – did so because they were affected by these ideologies which came in from outside. As for the callers and the youth who remained keeping a link/attachment with their scholars; then they were not affected by such incoming ideologies. So these people – and all praise is for Allaah – are upon steadfastness – just as their pious predecessors were.



Therefore the grounds for this division returns back to the da’wah based ideologies and methodologies conducted by suspicious and doubtful people – or people who are astray and desire the termination of this blessing in which we live within this country. This being by way of: peace and stability and ruling by way of the Sharee’ah and the abundant good of this country – that is not to be found in any other country. They desire to make divisions between us; and to draw our youth away and to remove the trust from our scholars – and thus at that time there will occur – and Allaah’s refuge is sought – that which would not have a praiseworthy outcome…”



The Shaikh continues later stating:


“I say: no one violates the honour of the upright scholars who are upon the truth except one of three types of people:


1. Either a hypocrite – whose hypocrisy is known.

2. Either a faasiq (evil-doer) who hates the scholars because they prohibit him from evil-doing.

3. Or either an astray hizbee who hates the scholars because they do not agree with him over his hizbiyyah (partisanship) and with his astray ideologies.”

MISEDUCATION AND FALSELY

 EDUCATED PEOPLE


What is miseducation and what is your advice to the youth who are in love with those who impersonate students of knowledge?

Miseducation

Miseducation  is to proclaim to have knowledge. The person claims to have knowledge, but he isn’t knowledgeable. He hasn’t studied with  the scholars. He has only taken knowledge from reading books. This make- believe caller doesn’t stand on any knowledge based principles. Rather, he has only read books and then he goes with his own understanding. In most cases he makes mistakes in issues more than he is correct about.

Falsely educated people:

The Falsely educated person is dangerous to himself and hazardous to others, because he acts fraudulently with Allah’s religion. If a person came to a people and said: “I’m a doctor.” I can treat (this patient or disease), but he doesn’t have any medical degrees. This person hasn’t any single credentials in medicine. Could he be allowed to give therapy?  Could he be allowed to perform surgery and open someone’s stomach - perform an operation on the heart? This is impossible, as well as, this is dangerous, therefore, how can a falsely educated person be allowed to play with Islam?! Acting fraudulently with Allah’s religion is more serious - than playing with someone’s body. Falsely educated individuals need to fear Allah! And refrain from speaking about Allah, without knowledge.  Allah placed speaking about Him ignorantly above Shirk.

“ قُلْ إِنَّمَا حَرَّمَ رَبِّيَ الْفَوَاحِشَ مَا ظَهَرَ مِنْهَا وَمَا بَطَنَ وَالْإِثْمَ وَالْبَغْيَ بِغَيْرِ الْحَقِّ وَأَنْ تُشْرِكُوا بِاللَّهِ مَا لَمْ يُنَزِّلْ بِهِ سُلْطَانًا وَأَنْ تَقُولُوا عَلَى اللَّهِ مَا لَا تَعْلَمُونَ

 “…Say! Indeed my Lord has forbiddenAl-Fawahish(great evil sins, every kind of unlawful sexual intercourse, etc.) whether committed openly or secretly, sins (of all kinds), unrighteous oppression, joining partners (in worship) with Allah for which He has given no authority, and saying things about Allah of which you have no knowledge.”(Al-A-raf 33)
It is must for those impersonators to fear Allah! And study… They need to learn (the Deen), before they speak.

ما هُوَ التّعَالُم؟ ومَا نَصِيحتُكم للشّبَاب المَفْتُون بالمُتَعَالِمِيْن؟ العلامة صالح بن فوزان الفوزان -حفظه الله-
ما هُوَ التّعَالُم؟
ومَا نَصِيحتُكم للشّبَاب المَفْتُون بالمُتَعَالِمِيْن؟
يجيب الشيخ العلامة
صالح بن فوزان الفوزان 
-حفظه الله-
ما هُوَ التّعَالُم؟
تفريغ يقول السائل:ما هُوَ التّعَالُم؟ ومَا نَصِيحتُكم للشّبَاب المَفْتُون بالمُتَعَالِمِيْن؟الجواب:التعالم: ادعاء العلم، ادعاء العلم، أن الإنسان يدعي العلم وهو ليس بعالم لم يسبق له أن تلقى العلم عن العلماء، وإنما تلقى العلم عن الكتب، والمطالعة فقط، وليس عنده قواعد علمية يبني عليها وإنما يطالع في الكتب ويمشي على فهمه، وقد يكون ما يخطئ فيه أكثر مما يصيب هذا هو.
المتعالم: وهو خطر على نفسه وخطر على الناس لأنه يتلاعب بدين الله -عز وجل-، لو خرج واحد على الناس وقال: أنا طبيب أنا دكتور أنا أعالج وهو ما معه شهادات طبية ما معه شهادات طبية هل يُمَكّن من العلاج؟ هل يمكن من الجراحة وشق بطون الناس والعمليات وإجراء العملية في القلب؟ ما يمكن هذا لأن هذا خطر، فكيف يُمكّن هذا المتعالم يتلاعب بالدين! التلاعب بالدين أشد من التلاعب بالأبدان، فيجب على هؤلاء أن يتقوا الله وأن لا يقولوا على الله بغير علم فإن الله جعل القول عليه بغير علم فوق الشرك.

(قُلْ إِنَّمَا حَرَّمَ رَبِّيَ الْفَوَاحِشَ مَا ظَهَرَ مِنْهَا وَمَا بَطَنَ وَالْإِثْمَ وَالْبَغْيَ بِغَيْرِ الْحَقِّ وَأَنْ تُشْرِكُوا بِاللَّهِ مَا لَمْ يُنَزِّلْ بِهِ سُلْطَانًا وَأَنْ تَقُولُوا عَلَى اللَّهِ مَا لَا تَعْلَمُونَ)فيجب على هؤلاء أن يتقوا الله وأن يتعلموا أولا، يتعلموا قبل أن يتكلموا . نعم "اهـ

Is There A Criterion That A Person Can Use To Distinguish  A True Scholar From An Imitator?

Question :

There are several individuals these days who claim to possess knowledge and, because of this, people have become very confused in their religion. Is there a criterion that a person can use to distinguish a true scholar from an imitator? Please benefit us, may Allaah grant you much good.

Answer by Shaykh ‘Abdul-Azeez bin Baaz (rahimahullaah)

In the Name of Allaah, and all praise belongs to Him. The sign of a true scholar is clear; he is the individual who presents the Qur`an and the Sunnah as proofs.You become aware of his correctness by asking the people of knowledge who know him. Also, a person should investigate and ask the trustworthy people about him, in order to be safe that he is (actually) from the people of knowledge. The true scholar is furthermore known by his (correct) religion and uprightness, and his diligence in seeking verdicts, and by the proofs he presents.

He is also known by his actions in addition to the recommendations mentioned by those who know him. It is not befitting that a person takes this matter lightly and asks anybody; rather one should investigate, as it relates to his religion, and ask the trustworthy and reliable from amongst the people of knowledge in his country or in the country he travels to.

This should be done in order for him to be at ease, because he has asked the people of knowledge regarding this matter.

What reason is there for a scholar to
hesitate to give a legal ruling?

A scholar may hesitate to give a legal ruling, if he is qualified to do so, and has knowledge, because the evidences that he has seem contradictory, or it could be that he feels that the questioner is not serious, as some questioners are not searching for the truth, they only want to play around, or to know the opinion of this scholar, and a second scholar, and a third scholar, etc. In such cases, the scholar may hesitate or may refuse to answer the questioner who knows, if he feels it likely that he is playing around in order to see what the people (i.e. the scholars) say, or he wants to compare some of the sayings of the people (i.e. the scholars) with others – and this is worse, for he goes around saying: “ The scholar so-and-so said such and such and the scholar so-and-so said such and such.” These are some of the reasons why a scholar may hesitate to deliver a ruling.

Stick to the scholars…

Shaykh Abdus-Salaam Ibn Barjas Rahimahullaah:

 “O student! If you want knowledge from its sources then you should stick to the great scholars [Kibâr-ul-'ulama]: those who have gray beards and weak bodies and have lost their power in [pursuit of] knowledge and educating. Stick to them before they disappear and take from their treasure before they take it with them.

One misses the full-moon in the dark night.”
